Hi,
I bought an Exhaust from China Parts in January, but due to being in the Armed Forces was not able to get someone round to fit it until last week. I originally telephoned the company with the make and year of my motorbike and they informed me what exhaust i needed. When it come to fitting it, it was the wrong one and have subsequently been told by the company that they do not do an exhaust for my bike any longer, and as i bought it in january i am no longer entitled to a refund even though it is brand new. Any help apprecited.0 -

The time lag here does appear to be a problem. It could be argued that the goods were the wrong ones but after a few months although the argument stands the time is against you.
I have read their refunds policy part of which states:
Contact must be made within 48 hours of receipt of the goods and the return of the items must not exceed 3 days of receipt of the goods purchased by the buyer.
Returns are only accepted in case of damage in transit. Refund of purchase cost excluding postage will be made upon return and inspection of your purchase.
A 20% re-stocking charge will apply for incorrectly ordered items.
The Purchaser has a statutory right to cancel their order and receive a full refund on any mail order purchase with the exception of Special Orders. To cancel the Purchaser must send the original or copy invoice along with full written reasons for the return, such written reasons and invoice to be received by the Company within 7 working days of the Purchaser receiving the said Goods. The return of Goods will be permitted in only limited circumstances if the Goods are received in their original packaging, labelling, complete with any accessories, manuals or other documentation and undamaged. (Original invoice will be returned to Purchaser in the event of more than one item being sold on it). Exhausts cannot be returned it they have been run for any period. Workshop Manuals or other written material may not be returned
Goods must be returned to the Company in a condition, which would be acceptable to our supplier for return. Tyres - no refund can be given if tyres have been fitted. In addition, the supplier has to give full refund and report to the Company before any refund can be offered to a Purchaser.
I think you should appeal to their conscience and write to them outlining the circumstances (serving Serviceman etc) and ask them to make a special case!

I have just purchased an item from tesco direct. Described as a stair basket, it does not fit, and so is not fit for purpose. I am able to take the item back to their store to claim a refund. Am I able to claim for my original postage costs as well? If it had been described better I wouldn't have bought it in the first place.

I am not sure that it would necessarily be not fit for purpose, unless it came with a guarantee that it would fit all stairs. Nonetheless, Tesco Direct are usually very good for returns. Also, if you have only just received it, you will be covered by the Distance Selling Regs.Gone ... or have I?0 -
hi, my dad who is elderly and dissabled had a mobilty scooter saleman round today, he brought with him a mobility scooter worth £2,000. my dad liked the scooter as it was a good solid scooter and paid £2,000 cash for it, but he is now having second thoughts as it has left his bank account quite low, he said the salesman was quite pushy with the sale and he took my dad to the bank to withdraw the funds, i would like to know if he can get a full refund if he ruturns it, i'm not sure if a cash deal is different to a credit agreement as i know you have a cooling off period with credit.
