1 before anything write to Voda & DCA - get a break down of the charges & bill copies, the debt collection agency have to provide this by LAW if asked for it - they contact Voda, you do the same DIRECT to Voda

2 send Voda & DCA in return proof of JSA income, get Voda to agree an amount to pay balance of contract for the remaining contract minus the extortinate internet charges - via letter, Voda have no right to sell your debt to anyone - the contract terms are between customer & Voda, unless you agree otherwise to DCA buying said debt

    3 send everything registered/recorded delivery

4 if Voda dont budge, tell DCA to take to court as you have not authorised transfer of T&C or debt due to Voda to anywhere outside Voda - provide all proofs of all letters etc in court, accept cost of contract minimum term minus internet usage costs from supplied copy of Voda bills, provide proof of JSA & sickness from doctor & evidence of other debts

ask court given circumstances to pay amount of contract term minus internet usage @ ( minimum of ) £5 a month to clear debt due ( a breakdown of income & outgoings are best at hand for court )

    thanks nathanhill69,
He has a depression condition and all his debt problems are not helping too. So all I can do is to give him a hand i suppose.

if thats the case he should be getting more than JSA

Complete twaddle I'm sorry. If the customer fails to pay a bill or enter into a dialogue with the service provider to either dispute the bill at the time or arrange to pay it will get sent to agency. The OP's boyf ignored FOR 4 YEARS requests to pay, so he has broken the contract. You don't authorise someone to take you to a debt collection agency, you just ignore letters for payment long enough and it's an automatic process. The OP's boyf broke the Ts & Cs of the contract.

    Sorry it's my BOYFRIEND.
He was 18 when he first took out the contract. Now he is 22 years old.

How come he was able to take out a contract at 18 when presumably he had no credit history to go on? Did he have a parent or guardian as guarantor?

  • I know plenty of 18 year olds who have mobile contracts with no credit history, in fact I got one when I was 18 and had never had any credit.

I would say the fact he has ignored it for 4 years may weaken his argument with Vodaphone if he tries to dispute the charges. I would get a copy of the contract and bills and check that the calculations have been done correctly.

I remember looking at buying a Vodaphone data card about 4 years ago on pay as you go and the charges per MB where about £3 so a £2K bill for internet would be 666MB.

Does he remember what he was doing with the phone on the internet? did he have it connected to a laptop or PC?

  • I will try my best to convince my bf to talk to VF, break down the bill and pay it off direct to VF, hopefully they would take that 1 grand interest/charges off. Would arrange it for 5 years payment as we can't afford to pay it off sooner. That would roughly cost us £35 a month which I can still afford at this moment.

I just turned 18 when I took out my iphone contract with o2 on august 2008, I have no credit history (no loans, no credit card) whatsoever but I put down £100 deposit.

I think that this is a good plan jaycee, but do remember that time is not on your side, ideally you need to do this today.

  • my first contract was a vodaphone one when I was 18, and i'm 22 now so 4 years ago as well and I didn't have a credit history and didn't need to pay a deposit either.

OP I know you want to help your b/f, but as said, he should exhaust out every option first before even contemplating taking your money to pay it off. My b/f offered to help me with my debt, but I declined, it was my problem afterall, and he didn't work hard for his money just to pay off my troubles. It is a nice gesture to want to do that, but you may also need that money in the future. Think about it before you start paying off someone elses phone contracts.
