    yeah i received the same letter today aswell.. i phoned up toys r us and told them about it.. they said theres nothing they can do as the deadline has closed and that particular packagae has sold out.

    ahh well.. never mind

  • I received a letter from ASA today, it basically said that they have advised toysrus of their responsibility to give customers a reasonable chance to obtain an advertised offer and that in the future they should offer similar goods in exchange of out of stock items.  Toysrus have agreed to abide by this but the ASA will not be taking this matter any further.

    So it seems like we are not going to get anywhere with this one.

    Thanks again to the O.P. – shame it didn’t work out for all of us though.

    First wrote back to them asa an tell em you demand a FULL adjudication. juss email em.

    Now mo importantly its time to bring in Watchdog to get that deal and shame lyin toys r us

    You guys need to get on to watchdog - they dont act unless they get several emails so use their form link elow or watchdog@bbc.com

    main points of thread complaint

    1) offer pulled a week early
    2) staff tried to sell £149 bundle instead of £89 - ripoff!
    3) breached the advertising standard codes as decided by the asa - mislead us and tried to rip us off and didnt give substitue as per code
    4) gave some bundles to some people who complained but not others even though they "agreed" to honour the code!

    The asas codes say clearly they shd substitute but they didnt and havnt for you guys either.

    looks like I might be the first to receive a letter back from ASA (arrived yesterday)

    "I am sorry to hear that you had difficulty in trying to obtain promotional goods under the terms of the promotion and appreciate that this must have been dissappointing to you. We received some complaints at the time of this promotion about which we contacted the advertisers. We were satisfied that the advertisers made a reasonable assessment of likely demand and ordered accordingly, but understood that their suppliers were unable to provide them with sufficient goods. We have explained to the advertisers that, although they may not have been responsible for the insufficint stock of promotional items, if non-promotional items of a broadly similar nature were available, the Code requires that consumers should have been able to buy these goods at the offer price.

    The advertisers have provided us with a formal written assurance that they will abide by the terms of the Code in future promotions. On the basis, we have closed our file and will not be taking the matter further. We appreciate that you feel let down by the standard of service you received in this instance. Unfortunately the ASA cannot retrospectively extend the terms of sales promotions and suggest that you take this matter up with the advertisers directly.

    I am sorry that we are unable to help you further, but I hope this letter has explained the rationale behind our decision."

    I actually went and got my xbox from elsewhere when I couldn't get this deal but wanted to write to the ASA anyway regardless of whether I got the offer (the games would have been handy!!)

    Looks like there will be no more help via the ASA on this one!
