  • Hi everyone hope you all had a good Christmas and new year.
    Just thought I'd give you all a quick update , was assigned an adjudicator in October who after 6 weeks found in my favour and asked Egg to repay PPI on loan plus interest and compensation for stress.
    Unfortunately for me Egg ignored this and did what they are consistant at doing, NOTHING !.
    Ajudicator said to me that we have to give Egg time to respond , I asked how long ? he said untill the end of December 2009 , If they do not respond there is nothing he can do but pass it to an Ombudsman , he warned me that because of the volume of cases going to the Ombudsman there is a bottle neck and there would be a long wait.
    Egg true to form did not respond.
    Apparantly extra adjudicators have been brought in, but not many (if any ) extra Ombudsman , the banks know this and are deliberately blocking the system, we know it, the FOS know it ,but nothing is done about it. If an adjudicators decision is ignored then the other party should win by default and a time limit for payment given otherwise more compensation should be given at a high rate of interest.
    Anyone experienced similar recently? How long do you have to wait these days for an ombudsmans decision ? I know it used to be fairly quick after an adjudicators decision but got the impression from the adjudicator that this is not the case anymore.

    I hate it when that happens, it have actually happened to us, where Lloyds TSB ignored and Nemo.

    Both were passed on to the ombudsman, it did actually take approx 14 months with Nemo, this was back about 2 years ago, with it going to the ombudsman as well.
    With my hubby's lloyds case this happened as well, his complaint went in to the FOS in 2008 and it had taken a while before it was passed on to the adjudicator, they ruled in hubbys favour but Lloyds ignored this, it was then November (just before xmas 2009) was the final result from the ombudsman again ruled in hubbys favour.

    If your in any financial hardship, then let them know, and request if this can be fast tracked to the ombudsman.

    Hope you don't have to wait too long and I must agree with what you said as well.;)

  • Thanks for the advice , thankfully I'm not in financial hardship , no spare money but in employment and keeping my head above water (just !)
    It's disgusting that Banks can get away with keeping money that is rightfully ours and lending out to others at 14% knowing they will have to pay only 8% compensation in the end to us and keeping the difference by ignoring what the FOS say .
    Still I'll get off my soap box now before I burst a blood vessel !
    I'll get there in the end

  • I got a car loan in 2003 with black horse who made me take out PPI as a condition of giving me the loan, at least thats what the sales guy at the Ford garage told me. I tried to claim last year with the standard letter but Black Horse told me to get lost twice. The garage I originally got the car from is no longer trading. Is it worth me trying again with Black Horse or not?
    I need to start saving so I plan to save £2 a week to start with:beer:

    I take it they have give you the final response?
    Did they give you details of where to take this to next if given the final decision.
    Not sure if these were governed by GISC where the FSA taken over in Jan 2005, they would have had to have been governed in order for the Financial ombudsman to investigate, but there is no harm in trying once more, see if they come back with anything, if they have not by 8 weeks, then write to the actual Insurer/underwriter instead who should have been covered by the above.

    However, If I remember correctly some have been successful over the recent months with these with loans taken out with them the same year as you, but please do not quote on me.

    The insurer is another direction to take, so I would if you can try to find out who these are as well just in case, as many of us have been in the same situation as yourself and have been accepted by the FOS after consideration.;)

    Just got a final response from ge capital Etam card they say because It is a long time since I used the card that ist has been wiped from there system so they have no details of my account they say that if I can come up with any evidence that I was miss sold then they will reconsider my case. They have given and address of finance and leasing association to refer my case to if i,m not satisfied . Anyone got any advice i would apprciate it Why not the fos ?

    Hi mollymoo. If this card was taken out before regulation and the card provider was not under FOS jurisdiction (ie GISC members at the date of your sale) when you took it out they are correct that FOS cannot help against them I am afraid. As regards the paperwork they are saying about, do you have any yourself? When was this actually taken out?

    HAPPY NEW YEAR TO YOU ALL

    I have just sent letters to FOS re two loans from TSB that were mis sold. I knew we had taken another loan in 2005 but am unable to find all the paperwork nd I wanted to check if this also, had been mis-sold. All i have is the letter from Lloyds confirming that the loan was our and date of first monthly repayment (2005). can we request paperwork from TSB and would we need to pay a fee to get it. All replies appreciated. Thanks to Di for all support so far.
