Hi iv'e just rung about my claim again asking why its taking so long i started it in august ,i was told because i've had my card over 6 years they had to retreive old statments to work out how much i've paid and then work the interest out ,she then added but i'm not telling you your claim is successful . What do you think? would they bother to work it all out if they wasnt going to pay me out ? Fingers crossed Sunny:confused:

    Hi Sunnygirls.
    Is this with the FOS?

I remember being told this with one of mine from a 2001 case, also my hubby's, his was taken out the same time as mine, also credit card but did take longer than mine.
Hope you hear soon with some good news.;)

Sure this has been asked before so apologies. I have just received copies of credit card statements dating back to 2003 (under credit card charges reclaiming) and noticed that PPI and PF ADI (littlewoods) have been added to the statements.
I am reclaiming for my mum, so am looking to reclaim the PPI, but it appears that it started prior to 2003 - how do I find out the start date of the PPI?

Also, does anyone know what PF ADI is? This is on an LPF card (managed by Barclays) and seems to be a set amount of £8.59 each month???

    Thanks in advance
Pay off as much as you can in 2011: £780/£8000
    Vouchers through surveys/shopandscan: £10/£250
    Ebay/Paypal target for 2011: £109/£1000

Just reclaiming PPi from an HSBC credit card closed in Dec 2006.
HSBC although not yet agreed have insisted that any refunds must be paid against my currrent HSBC credit card balance. I may choose ultimately to pay against that balance , however I am asserting with HSBC that as the account was closed in 2006 I should have the right to choose.
Anyone got any precedents / law that may help.

    Thanks

Hi I did a SAR for HSBC cards that came back "please be advised the bank is only advised to provide details applied in the last 6years and we are unable to provide further details". I was looking to reclaim PPI and charges against this credit card account which I closed in 2005 would I still be able to submit a mis selling claim? also I submitted a SAR over a month ago to capital one and have received no response what's the best way forward??
    Thanks

You could ask when you actually opened the accounts by asking for the agreements if the accounts are still on going and sometimes you can get them if not. This may say if a PPI box was ticked sometimes or you can request a SAR for the whole of the information they hold on you BUT seems you have most going back 6 years so probably a waste of money.

I personally would just write and ask when it was added or just get a reclaim letter off to them without knowing when.

This sounds pomising sunnygirls TBH. You are though free to take this to FOS if you want to as 8 weeks are up.

If there are no arrears or have ever been arrears on this current card with them then it would be unfair if they paid it against your balance with them. I would ask for the FOS to help if this is the case.

If you closed this account in 2005 then it is very likely they still have all the details. I would write and ask for a copy of the agreement maybe and send them £1 and post recorded delivery. You may get it this way OR just write a reclaim letter with the date and account number of the account in question and your name etc and your reasons for the missale. They should be able to trace it from there.

What do you need a SAR for, you can make a claim without it if you believe you were mis sold to. The trouble with asking for a SAR is that when they don't arrive people are put off from making a claim - don't bother just go ahead and make the claim - if they decline to accept and you take your claim to the FOS the FOS will only ask for the same information and they have far more power to get it them an individual does despite the Data Protection Act
