Sounds like a case of mis selling to me, whether he has the loan or not.

I dont have my loan anymore but I have still reclaimed the PPI. I dont think it should matter whether the loan is active or not but its more helpful if it the account is less than 6 years old which I am assuming this is from the date you gave.

The template letters are on here, there is a link to it all on the "reclaims" tab and take it from there, it will help if you have the loan account numbers etc

    Good luck

Hey, you are good at this...
  • I am spending way too much time on here !

I cant help it, I am amazed at the advice and friendship I have been given on here and I like to try and help others back :A

I just hope I am not giving duff info

    K x:rolleyes:
  • I've had a look at the letter template but i'm not sure which paragraphs apply?!!

Boobieloobie - what a fabulous name by the way !

Just have a scan through and look at the general bits, how you felt at the time the loan was arranged and what the advice given was, thats what I did anyway, was it suggested that you had to have the PPI to get the loan - that kind of thing.........

Also did you already have other arrangements in the event that you couldnt pay like sickness benefits from work etc so the PPI would have been useless anyway

Hello, please be careful with Halifax when I won my claim they asked me if I had any accounts outstanding with them. I got the impression they would have tried to pay these off first. If you are in arrears they will pay these off first and gve you the rest. But if they have said it will be a cheque you should be fine.

OH they cannot apply it to another account I don't think even if you are overdrawn with them. They have been known to pay it straight into a bank account though (seen it on here) if you have one but I would think it would have to be a savings account. Perhaps someone who has experienced this will post. If the overdraft is OK with them and they DID pay it into your overdrawn account then perhaps transfer it again if you need it for more important things that is.

    Hi marshallka

Thanks for your repl. We added the OD as part of our DMP and as such we agreed to kind of "freeze" the account with them except for accepting payments off the OD each month so we couldnt transfer money from it even if we wanted to. We also cut up our bank cards at the beginning of the DMP last year

his is my concern that they will simply pay it in despite our requests, although to be fair they said they would send a cheque, I am just assuming the worst because thats what I always do

We had an expert on here once. Troness was her name and she told us all when we said about the blind leading the blind................................

Indeed - but all "experts" start out as beginners at one time or another! I'd say from the pratical experience a number of you have had - you're far better placed for advising newbees on what to expect when dealing with companies directly.
Theory is one thing ... but practice makes perfect! :T

    So keep it up...;)

If they said they would send a cheque then all you can do is hope they keep their word. Good luck;)

  • Hi folks -havent posted here for ages but I do check post regularly & its great to read the encouraging posts!

Has anyone had any success with Barclays/Woolwich? I wrote to them mid Nov 2008 reclaiming PPI - wrote to A&L same day & they settled within 8 weeks. :j

Barclays latest letter was dated 8/1/09 (NB dated within the 8 weeks), posted on 15/1/09 & recd by my next day. They say they are not currently in a position to provide full response to aim to do so asap, tho no timescale is given. They also say as the 8 weeks has past I can contact FOS & leaflet enclosed, tho they "very much hope to be able to resolve your complaint without the need for this".

I have not taken any action since receiving that letter in the hope they would write again. Should I write & try to force a timescale for letter of settlement? Or go straight to FOS now? I'd be grateful for advice & any success stories. If others do it in 8 wks why can't Barclays!

    Many thanks in anticipation!

  • Been a tad quiet these past 24hours... me, I have been busy getting the new site up an running and been having a mare with it all.

Great to see new people come on board.

Got a new SAR from FP, and I have to agree with others that a shed load is missing, however I can see MANY issues with it, and new avenues for pursual.
