Hi, I have tried to claim on the PPI, and they have said no due to the pre-existing condition and it being a chronic condition. I dont know what to try claim for, ie what angle on the ppi, if that makes sense.

probably a stupid question, but if halifax havent cashed my £1 postal order, is there any way i can check if they have?? i didnt send the ltter recorded delivery sp am kicking myself now
I would perhaps do another letter and send another £1 recorded delivery too. I don't know if you can tell from your receipt about cashing the postal order. If you feel the PPI was useless then make a complaint about misselling it.

    Hi

Just for me to get this right now, you have tried to reclaim by complaining about the PPI due to a pre-existing medical condition?

Have you also checked out other reasons as well on this link here?
    http://www.moneysavingexpert.com/reclaim/ppi-loan-insurance

Have a browse through the link if you've not done so already, and if you still have your term and conds check through that as well, if you've no paperwork you could always ask if they can supply any or request a subject access request, you will find the template for this on page one of this thread with details.

Regarding the £1 postal order, did you post by recorded delivery?

You can check to see if this got there by using the Royal mail's track and trace section here:
    http://www.royalmail.com/portal/rm/personal?pageId=tab_track_rm&catId=500185&mediaId=83900761
by adding the tracking ref number on the receipt/slip from the post office.

I would ring them just to make sure hun, good luck.;)

"oops sorry marshallka, you beat me to it" lol.

    hiya,

thank you both for your replys,

the letter i had already sent was regarding my halifax cc, as im trying to lower payments for a while til we get back on our feet. that was the one that i sent with a £1 postal order as a token payment, and the one i stupidly sent through normal mail, not recorded, lots of the other companies got htem though!! i have wrote another letter inc a copy of the first with another token payment, this time it WILL be recorded!!

in regards to my PPI, i tried to claim as i had to leave work due to my health prob. in took 6 months and they said no, despite docs report etc. what im trying to find out is if i can reclaim as when they went through all the health questions they never mentioned anything like pre existing etc.

these are there T&c's on pre existing and chronic

Chronic condition - Any medical condition or associated symptoms which have at least one of the following characteristics.

    · It continues indefinitely
    · It is constant and controlled rather than cured
    · It has symptoms which reoccur and have required consultation, treatment or care on more than one occasion in the past
    · It requires long term monitoring or treatment, consultations, check ups, exeaminations or tests

Pre-existing condition – any condition, injury, illness, disease, sickness or related condition and/or associated symptoms, whether diagnosed or not about which you:-

    · Knew or should reasonably have known at the start date
    · Had seen or arranged to have seen a doctor during the 12 months prior to the start date.

When a claim is made for a pre-existing condition under the policy, the claim can be given further consideration if you had been symptom free and had not consulted a doctor or received treatment for the condition within 24 months prior to the claim (if you had appointments to see a doctor within this period and these were not kept, the exclusion will apply unless you had been formally discharged.

these are the same t&c's for my credit card, bill protector and mortgage protection, i have since cancelled the mortgage protection as we couldnt afford to keep paying without the claim with me not working, i have also cancelled the bill protector.

i signed up for my original mortgage protection on the phone at same time as applying for the mortgage, i am 90% sure they never mentioned a thing about these condiitions, only that I should make sure i had cover in place.
Please be nice to all moneysavers!

    Hi hun
I see, well I would write to them again as it seems to me you have a case here due to your medical conditions.

Anything you feel you were mis sold with then try, I would give it a go.

Good idea on the delivery side of things, but meanwhile just give them a quick call and say "I believe you have received my £1 postal order" in regards to you request and would like to know if they have posted anything back to you yet, this may catch them out, if they are open now give them a quick call.;)

I am sure others will also post up with their opinions on this as well, so please keep checking posts just in case, but like I said if you feel you have cases with any of these finance companies, I would complain and reclaim.

I wish you luck with all this hun.;)

If pre existing conditions were not mentioned to you when you took the policy out then make a complaint for misselling as this has proved useless to you.

    Hi all,

Just a quick couple of questions.

Have sent Lloyds TSB loan ppi reclaim to ombudsman after they refused to uphold my complaint. I sent it recorded delivery nearly 2 weeks ago, but they have not replied to say they have recieved it. I know that it was delivered, but there is no proof of delivery signature available on the Royal Mail website. How long does it normally take for them to acknowledge receipt?

Have also been trying to reclaim from an old RBS loan taken out in 1999. I've been receiving the usual stardard letters stating that they are looking into my complaint. However, it is now 9 weeks since my complaint letter to them, and I have just received another letter saying that they are still gathering all the evidence and would like more time. They also enclosed a FOS leaflet for if I wasn't happy with this. Is this normal for them or are they stringing this out? Lloyds TSB replied very quickly when they refused to uphold. Any advice on what to do next?

    Many thanks,

    Cocker:)

As regards the first complaint then its can be about 2 weeks from memory to acknowledge but others will no doubt post their views. As you no doubt know they are busy.

As regards the other complaint you are actually free to send this one now to the Ombudsman as 8 weeks have passed. Its perhaps best to get the ball rolling. I cannot understand companies doing this as they charged for each complaint that goes to the Ombudsman so why they have to stall things is beyond me.

There is usually lots more to answer on here and no doubt they will later.

    Good luck

    Hi Cocker

Sometimes they do not confirm a signature, some do and some do not.
But keep checking anyway, think the post office did say something about 15 days this can take.

I know these companies have huge volumes in these complaints, but if you feel you had enough of waiting you still have the option of taking this to the FOS, that is your choice hun, you can still prepare for the FOS.

If you decided to do this, enclose a copy of the FOS complaint form with a letter to the finance comany, tell them you have enclosed a copy for their records, they can still investigate, if you get successful then just let the FOS know.

    Good luck.;)

    Many thanks to you both!

Sorry, cant click your "thanks" icons. My computer doesn't seem to let me do it. It just goes blank and logs me out of MSE!:o

    Any ideas?
