    I have just received acknowledgement from Citifinancial today that they are looking into my claims, however one of the loan agreements I sent was not included. I have just come off the phone to them and the guy said that because it was not in the 6 year time frame they dont have to investigate this is this correct?

    They still have to investigate any complaint from what I am aware and I bet they are just trying to put you off reclaiming. Loads have reclaimed even through FOS beyond 6 years so if they do not respond and give a final response within the 8 weeks then I would go straight to FOS with it.

    Im in need or some help Please!

    Im trying to claim back some credit card ppi and charges, from Capital one, But i have no statements or any details of my account with them. so how do i regain this infomation???
    Plus can anyone provide me with an adress and telephone number for capital one?

    Having now confirmed that I did not tick the box for PPI on my AA loan agreement, I have decided to send the claim letter today to get things in motion, and send the SAR request in a day or so, so that can start being processed too in case I end up needing the info later on.

    This is my claim letter - I've edited the template a fair bit, as there is no opportunity for them to 'satisfactorily justify' the ppi seeing as I didn't tick the box!

    Does it seem ok? :confused: I don't want to come across as too bolshy, but likewise I want to make clear that my case is cut and dried in the hope they will settle fully and quickly. :beer:

    Dear Sir or Madam,

    Agreement number: *************

    I purchased the above loan from you on 21st March 2006. Looking recently at my statement, I now realise that a payment protection insurance policy (‘AA Creditcare’) has been applied to the loan since the commencement of the agreement.

    As you can see from the attached copy of my signed agreement obtained from yourselves, I did not tick the box agreeing to purchase this policy.

    Therefore I have been paying for insurance that I did not agree to, and did not know had been applied so could not have been explained to me.

    I am requesting a full refund of all premiums, and subsequent interest on these payments, that I have paid to date. As I believe I have been deprived of this money I also expect 8% statutory interest, the amount a court would award, to be added to each payment made.

    I look forward to a full and prompt response to this letter and for the matter to be concluded within eight weeks or I shall be contacting the Financial Ombudsman to investigate my complaint.

    do you think i should request a sar from them, or do you think they will only date it back 6 years again, as i have only one copy of a loan from 2001 but do know we had previous ones to that as well.

    Well i just got off the phone to them. Unbelievable! On my address i put 8/2 ***** **** ***** for my address. Which indicates the street number then flat number. They couldnt find me on the system as he was looking at it as house number 8 and didnt think to check for flat 2????? :rotfl:

    A SAR would mostly go back for 6 years so maybe a risk here in that it would not bring anything up. If you have the loan agreement for the one of 2001 and it goes to FOS I would think FOS would include this one as they did with mine. There was one of mine from 1997 that both myself and the bank did not have details of so was dismissed but not for the reasons they have told you and I would think FOS would take a dim view of that anyway.

    Should i ring them and ask if this is their final response to the earlier loan then or what do you suggest, on my loan agreement that im talking about was dated 2001 this was to consolidate another loan with them as it states refinancing amount etc...:o
