    Hi Steve and Sarah

I would ring the FOS on this tomorrow and they will guide you from here, details here:
    http://www.financial-ombudsman.org.uk/contact/index.html

Explain your letter response to them, many cases to what I am aware of within loans.co.uk are being dealt with by the FOS.

Good luck, please keep us posted, and the FOS will help you.;)

Almost forgot to add, that don't think loans.co.uk sells finance now, so its taken up with the FOS instead, there are many on here who are in the same situation, but your complaint will not be turned away - you will be ok.

  • Hi everyone,

I'm really sorry if I'm repeating things which have already been discussed on here, I just wanted a little clarification :)

I'm going to attempt to reclaim the PPI which was missold to my partner back in 2005/6 on a personal loan. I've been doing a little background research on the company in question, at the time they were Household Bank, they're noe Beneficial Finance (part of HSBC). I understand that in Jan 2008, the FSA fined HFC Ltd £1.085m for misselling PPI between Jan 05 & Feb 07.

Could anyone clarify for me whether this judgement affects them as their new name Beneficial Finance & whether it strengthens our case for missale? This might sound like an obvious question, but there is quite alot of money involved & I don't want to have misconceptions.

Thankyou so much in advance! :D

That is fine, and ask away.:D

This is fine, and should strenthern your case, but you may also have other reasons as well, you can still try reclaiming even if the business were not fined, just as long as you have reasons for being mis sold, go for it.

Thankyou so much in advance! :D
For more information, here is Martin's useful guidelines of reclaiming link below, you will find useful info, a checklist of mis selling reasons, templates etc.

You do not have to use the templates if you don't want to, but as a guide, with your reasons you have, they have 8 weeks in full to respond.

Keep at them until they resolved in your favour, or until they issue you with the final decision - which should enclose details of the financial ombudsman service (FOS), you can take your complaint to these if your not happy with the outcome.

You do not have to write the amounts in the letter, and best to post by recorded delivery as well, this is your proof of posting.

Please keep us posted and ask for further help if required good luck.

  • Thanks! :D

I'm using the template provided on this site, there is a short paragraph which it says to use if the provider has been previously fine - which mine has - but also, it lists possible evidence for missale, is it worth including these statements about why we think we were missold too, or just use the paragraph about the provider having been fined before?

    Your welcome Littledancer.;)
I would write as much as you can to strenthen your case, if you also have other reasons, this way you have covered it all in one letter.
So what ever occurs to you then.;)

  • Thanks. I've drafted the letters with reasons for missale & the bit about the FSA judgement.

Whilst this complaint is ongoing, do we have grounds to stop paying the PPI premium? Or is it best to just continue as normal?

    Hi Littledancer.

This is your choice now, you can cancel if you want to, but the repayments may not reduce by that much.

If you still have the terms and conds of this policy check the cancellation terms.

Remember though if successful, you should receive all of this back in PPI, plus interest where they then must remove the PPI, so either way is entirely up to you.

    Good luck.;)
