Hi Gary
I would move on to the Financial ombudsman service (FOS) now, with your reasons I believe you have a good case, even if this was sold online, at the end of the day the FOS will see it as worthless to you, so you have been out of pocket due to this, go for it Gary.
You can contact the FOS to arrange for them to post you a complaints form, or download and print one off on their website here:

Thanks for the reply. I guess my problem at the moment is when I sent in my letter to egg I thought it was a phone conversation and not online, therefore, should I write to them one more time and change my reasons to single premium, pre-ticked box, and I was only working part-time work. Should I also say in the letter to them that I thought it was online and not phone, hence my previous reasons, or just miss all that out?

It may be useful Gary for you to request a Subject Access Request (SAR), they have 40 days to comply, and they should send everything as requested on the SAR letter template, this should include any telephone call recordings if any and/or transcripts of the calls and what they were about.
However you could just write a quick letter to ask if they are able to provide any telephone calls recordings for free through the post.
Going back to the SAR request, there is a charge of £10 postal order or cheque payment, here is the link below for the template on this:

Hi - HBOS is trying to extend the time that they take to respond to my complaint re a mis-sold single premium. Am I correct in thinking that they have to respond to my complaint within 40 days or is that just the SAR?

Hi guys ill try to be quick basically my husband has ppi on mint card i wrote to them in march 09 telling them it had been misold no reply wrote again in june after the 8 weeks no reply sent 3rd letter in july after the four weeks no reply again so wrote to fos to make complaint received letter saying they were looking into it, received letter from rbs today saying due to the significant passage of time (the card had been issued in january 2003) the time has passed and is basically out of time . We are only in the 6th year and if they had replied in march 09 with my first letter the time would not have passed basically guy's is this a fob off from rbs and can i still continue with the complaint.They are saying if we were unhappy with the policy and believed it to have been misold at the outset, it is reasonable to expect that we would have raised concerns before now. any advice would be gratefully appreciated. thank you all.0

Did you send all your letters by recorded mail?
If not, they probably just denied receiving it even if they got it.
I think since it's been in the media recently, people are only now realising that they've been mis-sold and can actually do something about it.0 -

Hi there and do not worry about rushing lol....:D.
I think that may be a fob off, contact the FOS and I'm sure RBS were covered by GISC prior to the FSA in Jan 2005, as them being a bank, the FOS will check this out for you on the telephone.
The fOS are able to look at complaints that are regulated by these regulators, but still in my opinion I think they are trying it on.

PS, also just to say that I was successful via credit card ppi sold by lloyds tsb on a purchase in 2001, and some have been successful on even earlier years.The one and only "Dizzy Di"0 -
Thanks Di rbs want extenuating circumstances that prevented us from advising of our concerns before now, they want to consider the reasons prior to referral to the FOS. they state in the bank's view they think the ombudsman may not be able to consider our complaint in view of the time that has elapsed since we became aware that we had cause for complaint. thanks again di0
