    Hi all - just wanted to ask for some advice. As previously stated on here the FOS awarded in our favour against First Plus and we received a letter on 21st July saying that First Plus have four weeks to get in touch with the money and a new repayment plan. We were away on holiday for two weeks of this and we were expecting to come back to a cheque. However we have heard absolutely nothing from them and their four weeks is up on Tuesday next week. Is this usual? and is it worth me re-contacting the FOS on Monday so say we havent heard anything. We were quite looking forward to receiving the money as it is quite a big amount and I am now worried this could drag on for a long time. Anyone had any experience like this before? Many thanks everyone. Debs
  • Guys - when you send your claim letters consider the following (I was given this by a barrister friend of mine)...

    The 8% statutory interest is the minimum you should claim. If the APR on the card is higher than 8% claim at the higher rate because you can argue that the money you have paid for mis sold PPI would otherwise have been use to pay off the loan.

    I have successfully argued this point in a letter I put together for my elderly mum against PPI she had been mis sold for a storecard. I added the following text to the letter ....

    I require you please, to repay me all the sums I paid for the payment protection insurance which was misrepresented to me and mis-sold to me by way of equitable compensation (Wilson v Hurstanger [2007] EWCA Civ 299 at paragraph 49).

    This amounts to a total of £xxx. A schedule of the payments is attached to this letter.

    Further pursuant to the County Courts Act 1981 section 69, I claim interest at the APR of [insert card interest rate] %. It is just and equitable that interest be repaid at [insert card interest rate %] from the date each payment was made until the date of judgment or sooner payment because the money paid would otherwise have gone towards discharging the indebtedness under the credit agreement.

    Wouldnt surprise me if First Plus sent it Monday for you to get it Tuesday.
    If no one else replies call the FOS on Tuesday and take it from there.

  • after reading success on claiming PPI's for loan and credit card, I sent my first letter last thursday following Martin's template. Hoping a good result.

    My claim form was received by FSCS on 12th Sept claim no 282, and yet it has been sent to deloitte. Others sent to them have a much lower number.
    It could be they are prioritied in date order from when the application form was returned and not neccesarily the number we were give at the start.

    We were given the number at the start of claim, and sent it back within 2wks.I would therefore expect it to be placed in order of receipt, rather than account no. Some may not have sent theirs in for several months as we were given 6mths to complete them. What do you think.

    Were we assumed it was in strict account number, I don't think this is the case, i'm sure t must be date of receipt - it has to be.

    I read there were 600 claims, so maybe the have been split between them. If they have to complete to timescale this would make sense to outsource. I think I read on the FSA site the new aim was to complete within a three month service level agreement:confused:

    Our claim is number 20.

    We signed the FSCS form on the 18 Aug 2008 so would probably have sent it back on the following day.

    I think my theory may be correct as in the order they are being processed.

    Although i would expect priority cases such as Dialysis to be dealt with first.
