    Even if the loan is paid off then you can still claim misselling if he has reasons for this. You can get a copy of the agreement by writing to the firm and asking for one. They charge £1 for this and it has to be supplied in 12 days to you. There is another way of requesting a SAR (subject access request) and this is everything that they hold on you and includes phone recordings etc but cost you £10 and takes 40 days to get it. If you are sure of this missale then perhaps the agreement would be the best and just fire away with a letter.

    Don't forget to send everything recorded delivery.

    There is template here for the SAR if you decide to get all records

    Basically, this did not actually work for me, but as this is one of those Single premium policies be careful, they are not all they make out.
    They should go along with it yes, but if they do is another thing.


    2. Can I write PPI reclaim letters next week and also start DMP at the same time? If I do so is there any possibility that the lenders will not agree for my DMP. OR give myself 8 weeks to sort out reclaim and then go for DMP. I am not sure where to start. Can you please give a detailed explanation.
    From what I know of your better off doing a DMP with a free debt organisation, such as the CCCS, or Payplan or someone alike, do not go for any of the companies that charge though, you will find more info on the Debtfreewannabe thread above on this matter.
    They will send you the sufficient templates you need, as to what I know of some businesses do not agree but if this is the only way, then they have no choice, but do use a company if you have not planned so yet, they will also supply you with a Client Ref number.
    And yes you can still start on your PPI reclaiming, obviously though in another separate letter.;)


    3. Also for the PPI reclaim to which address I need to post the letter-- is it to the local branch where my loan is held or it is to the head office.
    If they have a Complaints Dept write to them, you can google your bank in and write complaints, or if they do not have a separate complaints dept then yes write to the Head Office, this will still be passed on to the correct department, or they should make sure they pass it on for you.

    as we are sure of the missale i just ask for copy for agreement
    i only have the last 4 numbers of the account agreement would that be ok to get a copy? i do know the date i took loan out thou
    and do i send it to head office or a certain dept

    I FINALLY got a reply from Cap One. I closed my account with them last year so I wrote the standard letter about being mis-sold my payment protection. Now I closed the account last year and I do not have the card anymore or any statements obviously. I gave them what I could find which was the last 4 digits from my account number on an old statement I found by chance, they never put your whole account number on their statements you see and my new and previous address which the account was held at when I had it. They have sent me a letter saying that what I have sent them does not match any of their records! What a croc!

    They CAN find me on what I have given them cant they? It was only last year and they have my name, DOB, addresses etc. so they are just being awkward arent they? Will I just send them a cheeky letter stating I'll pass it onto the authorities then?

    They are having a laugh!!!!

    Useless!!

    hi matthew, do not cancel ppi for a rebate, you will still pay the remaining ppi over the term of the loan even though you have cancelled it, and you will not have your loan reduced by a decent amount, this is why these front loaded policys are crap, go for mis sell and if you win you will be much better off, you go for it and good luck!! if you need anymore help just ask

    I think sometimes where are lots of people complaining about the same company and same complaint then from going by this site there is often a rush of redress's where I assume there is an agreement with FOS. I am not 100% sure but it certainly looks that way. I know of people that have had complaints in with certain firms (and not fast tracked) and they have had "goodwill gestures" without admiting liability. I assume its when there is a threat of a large fine perhaps.:cool:


    Like I say, this is not 100% but just from here on this site and tracking....
  • Hi I am new to this Forum and have just left a message on the successes regarding EGG. I have just banked a cheque for £685 PPI refund all dealt within a month.
    However, GE money (now Santander) are really messing me about. I have a Dorothy Perkins Account card -taken out in 1987 and a Wallis card taken out in 1996. They have admitted in writing that large amounts of data on my accounts have been lost but deny miss -selling as Creation Finacne actually managed the card sales then and they have no control over sales staff. Creation say thatthey passed everything over to GE Money (now Santander) - who inherited assets as well as liabilities. The letter from Santander is full of contradictions and factual errors. I have written asking them to re-consider. Has anyone out there had any success with GE Money?
