Losing my job is too big a gamble for this. The bank would clearly be wrong to process a default, but they would do it anyway and it would undoubtedly take a year or so to get to the default stage, then have them puruse this through the courts and after having spent the last decade fighting depression and anxieties due to money worries, I'm not sure I would be willig to challenge them on that basis.
I have had an approach from a 'friend of a friend' who runs a finance business and who is now taking on 'no win, no fee' cases involving credit agreements, and if I am unsuccessful with the PPI matters, then I think I'll contact them and see what they can do.
Unfortunately the route suggested by the FOS to resolve this is not one I'm willing to lose my job / career / house / health over.
I agree and the court route is a big gamble and can be costly too, FOS must think we are all rich.:wave:0 -
A cheeky catalogue company defaulted me when they replied they had no agreement. I was still paying , they just assumed I would stop. The FOS said they would not have done that. Then FOS had to apologise when they rang the company ,who said they had defaulted me and would remove it.DS1 12/10/04

I know that Sainsburys are and would be breaking the law by continuing to process data about me, but they've been doing it for nearly two years now with me! A retrospective apology and a retraction would make no difference to me if I lost my job - the impact on my health for fighting them for another year, and having the additional pressures of 10 or so calls a day pursuing for money (and yes, I know they are not allowed to do so as it amounts to harrassment but they ignore those letters too!). I'm not lucky enough to live in a two income household. I support myself. If I don't work, I can't pay my mortgage, so I would lose the roof over my head.
Having battled depression and the feelings of being a complete failure (it's a self-esteem issue!) over the last decade, the one thing I do take great pride in is having a lovely home and a career I've worked hard for. It's one of my few successes in life. Take that away and I'm not left with much. Sainsburys aren't worth feeling suicidal for.

In theory! In practice, banks do whatever they like! Halifax issued a default against me even after a court date was made in respect of bank charges - it took about 4 months to get that removed! That was one of the most stressful periods of my life. Panic attacks became a daily occurrence for me and after 2 hospital admissions in a week for collapsing through hyperventilation, I was eventually assigned a counsellor who tried to find out what the problem was and what was causing the panic attacks. One work - Halifax!
I'm not a strong enough person to even contemplate non-payment as I believe this would end up just making me ill with the stress which is why I've taken the route I have in continuing to make regular payments and hope that the FOS would look at this issue and see that 'something isn't right'. It seems the only way to challenge these guys it to become a defaulter - albeit until you go to court and get a decision - and take the daily pesterings and bullying of whatever pressure the bank puts on you in the meantime.
Not only must the FOS think we are rich, but also built with balls of steel and have nothing to lose. It's a shambles that being taken to court by the bank for non-payment seems to be the only way to get his resolved! What kind of system suggests non-payment, default, debt collections agency pursuance and all of that nonsense wasting everyone's time and effort is the best way to resolve this type of issue?
Whomever drafted the CCA 1974 should surely have thought of a realistic means of dispute resolution?!
Fingers crossed my PPI claim is better received by them - pre-ticked box, pre-existing medical condition, and a copy of the policy sent 5 years after the original agreement was taken out! Surely, surely surely the FOS can see that this one is a no-brainer?!Almost debt-free, but certainly even with the Banks!0 -

I'm really sorry if this is replying in the wrong thread, but basically I was paying PPI for the whole time I had a Halifax credit card and never claimed. I've since closed the credit card, I had three different cards due to Fraud, so on the template letter I don't have an account number? I also had numerous charges of £12, but have no records of them. Does anyone have any advice? Much appreciated!! x
Were you mis sold the PPI on your Halifax card?
For the charges send an SAR (copy on page one of this thread) this should get you statements with the charges on.DS1 12/10/04

After sending an e-mail to egg cancelling and subsequently complaining about my repayment protection, I have yesterday recieved an email from them saying my new interest rate would be 26.9%! Not totally sure about it but had enough of them. Gonna get a loan out to pay them off but bit cheesed off by their attitude.
Also received the standard "sorry, we're still investigating your complaint letter" from A&L afetr five weeks.0 -

I take it then you have no paperwork with the account number on?.
How long ago are you going back here in years hun?
Regarding the charges I assumed £12 was the norm, unless someone can confirm otherwise and this may come under a different category, under credit card charges where there is a thread for this on this forum.;)
I would start by contacting them to ask what details of yours would they provide without an account number, they will obviously ask security questions.
If this was over the last years, maybe the last option would be to request a subject access request, the template for this in on page one with details, but if they could send you anything free of charge, ask them first, otherwise an SAR maybe your only option here where this is a charge of £10 for this either by cheque or postal order payment.

I've been trying to reclaim PPI money,but now i've got another obstacle on my way..
Wrote template letter to Zenith Staybrite ,today received reply saying that Zentih Staybrite were part of Bowater Home Improvements(or other way round).And Bowater wend into administration last january,so now remaining order book changed hands to Weatherseal Holdings.
I found on internet that Weatherseal saved Zenith and they will keep their name.
What i dont understand is to who i've got to write next.I believe that Bowater was only my installers and Zenith the company who arranged my finances.
If Weatherseal took only ,,remaining order book,, who took care of my finances..Is they still belong to Zenith?
It a bit confusing but i hope someone will give me some advice..Thank youGood Luck Everyone!:beer:0
