    hi their everyone

    q1) , sent my 1st letters off to all my credit card lenders last week , , cap one , aqua , style , asking them for all insurance charges added onto my statements every month over the last few years , and especially barclaycard in rgards to their ppi which ive had with them , put my £1 in each , and style and barclaycard are demanding £10 each for the information im requesting . is this normal practise , what do i do now , im especting the rest doing the same

    q2) , i still have all my credit card statements for all of them , but dont understand the wording used , is their a site that explains such things in regards to all credit card companies staements , ie the terminolgy and wording used , if so i can desifen whats what myself and find any hidden insurance charges ect:confused:

    If you were requesting your agreements only, this is where you pay a £1 for these.
    They should supply by 12 days.

    In regards of other information you requested, if they don't send them to you free of charge, its a case of requesting a Subject Access Request (SAR) for these, unfortunately this seems to be the case for most companies, although some have been lenient enough to send without being charged.

    But with a SAR they should send you everything they hold on you as requested on the SAR, however this may even help your case and support your complaint if you decided to take them to the Financial ombudsman service (FOS).

    This is what you pay £10 payable by postal order or cheque payment, and they should comply by 40 days, and post by recorded delivery.

  • Can someone help?

    Received a reply from M&S Money today rejecting my complaint. Had written to ask for refund of PPI. There letter says:

    "The PPI part of the application does ask that customers tick the box if they do not want the cover. Therefore, it was automatically added as the box was not ticked. I can confirm we were allowed to sell this insurance in this way at the time.

    When this policy was applied to the account M&S Financial services acted as an unauthorised intermediary for the sale of PPI as we were not a bank or member of teh GISC at the time of this sale."

    I applied for the card 17 years ago when I was just 19 years old and very wet behind the ears when it came to anything financial. I remember opening the account it was a case of "would you like an account?", "OK", "fill this form out then".

    Have I reached the end with this one or is it worth carrying on?

    You could try and ring the FOS and see if they can help you

    17 years ago is before general insurance regulation. Does the letter tell you that you are not able to refer your complaint to the FOS?

    Hi everyone,i need some help if possible! i posted here last week about me wondering if i could qualify to reclaim ppi(or ppp as they put it)from black horse.So di3004 or amersall you might remember me!?
    anyway i have a loan agreement with black horse,the loan is combined with the ppi so the account number goes for both.(although on the small print it is seperate)
    So i'm wondering how i should word the first template letter from this site to ask for my money back.
    questions:- the first template letter states about purchasing a "policy",does that mean the loan,the ppi or the whole agreement? the reason i ask is i take it i'm sending this letter to ask for the ppi money back! i'm just wondering if the template letter is designed for the ppi agreement alone?
    i don't want to send them a letter asking for my policy money back and they might think i'm asking them for the whole loan + ppi back. OR AM I ASKING FOR THE WHOLE AMOUNT? i just don't know,that's why i need some help on this!
    Do i need to re-word some of the letter to suit?
    I hope you understand what i've written because it looks like a bit of a ramble to me! lol

    Banks were under the Banking Ombudsman and have been claimed from way back in 1997 (maybe before that??) from posts on here. I do agree though that with M and S they would not have been part of any of the past schemes so very unlikely that FOS would be able to assist and most probably too late for the courts too. Its such a shame when they were all sold in the same way though.

    You are just asking for the PPI back if this was missold to you and this would be on the agreement as a loan to pay for the "policy". You had to buy it upfront so you loaned the money (more debt) to pay for this policy so both the ppi and loan that you originally had are on the agreement. If you ask to be put back into the position as if you never had the PPI and 8% statutory interest on top (as you were deprived of the money) then that will be ok.

    It is best though to do your own letter with your own reasons for misselling.

    No the letter says " Complaints we cannot resolve can ultimately be referred to the FOS"

    Do I write back to M&S saying a don't accept their rejection? Give them one more chance to offer to settle or go straight to FOS?

    You have to give the company 8 weeks for a final response and if they have sent this in their last letter then maybe they will not write back to you even if you write again.

    I don't think 17 years ago M and S were under the jurisidciton of any of the former schemes (you would be best to ring the FOS and ask) before the banking ombudsman and the regulation of Insurance from the FSA in 2005. If they were members of GISC then GISC only came about after your sale and before that there was a banking Ombudsman, Insurance Ombudsman etc but doubt they were part of these either. I may be wrong but it would probably be best to ring the FOS first and see what they say. Maybe there is another scheme that M and S were under and you would be able to complain to them. I would not want you to go down this route of thinking FOS could help and they tell you "no can do".

    Who is the agreement with? Would FOS accept them as the people to complain to perhaps?
