    I quote the Ombudsman:
    "You will be very pleased to hear that following our intervention, Barclays Bank Plc has told me that it wishes to offer to settle your complaint on what it describes as a 'goodwill basis' and without any admission of liability."

    This is extremely good news to us and reading through the letter from the Ombudsman they are going to pay out on what we wanted, ie:
    All PPI paid
    8% per year on top of the PPI paid
    8% on top of the total PPI & Interest between the day the PPI was stopped and now.

    My only concern as it does not state it anywhere is how far back will they pay out. Although the card was taken out in 1996 will they pay back the PPI & Interest since then? I have until 7th April 2009 to accept this settlement, but I'm concerned I could get ripped off. Any advice would be appreciated.

    Another part of the letter also concerns me a little. I quote the Ombudsman:
    "As yet we may not have considered your complaint. If you decide not to accept the offer and we consider its merits you should be aware that ultimately an ombudsman may award a higher or lower amount or make no award at all depending on the outcome of his investigation."

    Just wondering if anyone has had a similar experience and what I should consider doing next.

    I'd appreciate any comments/advice.

    You could ask the FOS to see if they can get hold of the figures for you, explain you have nothing to work on.

    I note that someone else had this problem on another thread earlier and the FOS told them it may hold or delay their complaint, but yet when my hubby asked the FOS they got hold of the figures straight away from the company, well the following day, it may be worth you asking, good luck,;)

    And your last paragraph is the usual comment from the FOS.

    Just a quick update. I phoned up the FOS this morning and the guy there told me that Barclays have a set criteria to follow on working out the payment. He told me that they will pay me back 6 years from the day of my claim. He also told me that by signing the acceptance we are only accepting the offer. If however, we are not happy with what they pay us then we can complain to the FOS. I was hoping we could claim all the way back to 1996, but 6 years is better than nowt!

    Tomorrow I'll be calling Barclaycard up to see if they can give me the calculations and also if they can verify what they intend to give us in advance. The FOS advised me to do this as he didn't have details or contacts/phone numbers in Barclays.

    We'll see anyway and I'll keep everyone updated with how it goes. Thanks Di for your reply. I notice that you help so many people. Top girl, cheers.

    This morning I spoke with Barclays and then the FOS.
    First of all Barclays:
    The guy told me that I would have to go back to the FOS to get the calculations/amount. He confirmed the payout would go back 6 years. He told me that he did not have access to any further information as the 'Directors' (?) sort that out. He told me to liaise with the FOS and could not understand how they could not get the information for us.

    Secondly the FOS:
    The lady told me that it was a very complex method they use to work out the payment and basically if we sign the form we are agreeing to the standard method of calculation that they are using and basically it is worked out by putting us into a position where we never had the PPI in the first place. If we don't agree with the calculation then we can appeal to the FOS. Barclays will provide the calculation, but we don't find out what the calculation is until we actually sign the form of acceptance.

    So our next step is to sign the form and send it by recorded delivery to the FOS and wait and see what Barclays offer us.

    I'll let everyone know how we get on in due course.

    26.06.09 - Update and good news for us.

    Barclays Credit Card
    We're still waiting confirmation of the payout we are going to receive, but it has all been agreed and we are awaiting the paperwork. I have phoned up the FOS asking why it is taking longer than the time specified, but they confirmed that it could take up to 12 weeks due to the backlog in claims, etc. so nothing to worry about.
    We should receive something within the next month hopefully....

    Capital One
    Have agreed to our claim for compensation and were quite quick to pay up once things got going.
    On 5th June we received info that we would be receiving £979.97. The breakdown is as follows:
    PPI Premiums charged: £844.98
    Interest we (Capital One) have added to these premiums: £5.43
    Gross interest on premiums paid calculated at 8%. Representing compensation for the loss of your opportunity to do something else with the premiums we charged you: £129.56.
    Total amount to be refunded: £979.97
    Today we received the cheque for the amount above, which looks about right to us considering the short length of time my wife had that card in operation.

    I'll let everyone know what Barclays give/offer us in due course. I have to say nothing was given to us on a plate. If you are reading this for the first time, then you have to follow the sequence of letters (and knockbacks) and keep pushing. It has paid of for us.

    DO NOT GIVE IN TO THEM!!!

    I had one of my loans that was also with a bank redressed and that was going back further than 6 years. Usually with banks the only problem of going back further than 6 years is the paperwork issues and my bank told me that they did not have mine for one in 1999 but unfortunately for them I did and got the adjudicator to intervene with it and won. I hope you get back what you have a right to get back.

    Details of:
    SAR (SUBJECT ACCESS REQUEST)




    For anyone requesting a Subject Access Request (SAR), they have 40 days to comply and send you all the information they have on you on your accounts.

    £10 cheque payment or postal order is required.

    Always post by recorded delivery.

    When you receive the SAR, you should receive all that is requested within the template, if in doubt just post up here where someone will be able to confirm what is what.

    You will or should receive all information going back as far as 6 years, you may be lucky to receive information going back even further, every company varies from one to the other.

    Write again to the company if you believe they have not given everything requested, they should write back within a short time and confirm if that is everything they do have on you and your account(s) with them.

    You do not always receive recorded discs, however phone calls made Jan 2005 after may have been recorded, where they may then supply the recordings, but otherwise you should receive transcripts of dates, times etc of when calls were made and the reasons for the phone calls.

    If there were a joint loan taken out, and you both require details, most companies will want 2 payments of £10 x 2 = £20 cheque or postal order and require 2 signatures, check this with the company concerned to save on time and any come backs.

    Again if you feel let down you can always contact the Information commissioners Office, known as the ICO who will be able to direct you here, here is the ICO website for your interest, check this out, as more information will be within their website.

    I have received the relevant info from NEXT but GE Money (Debenhams) have not replied yet and it has been 2 months since they received the letter requesting information from us (confirmed by Royal Mail Tracking). I have made up a letter to GE Money of complaint, but just wondering if I can use any other ammunition seeing that they have readily received the letter as confirmed by Royal Mail and also seeing that it is over the 40 days that they are supposed to reply by.

    Any advice appreciated

    I would contact the information commissioners office (ICO) ask if they can help on this like chase them up for you, here:

    They should have complied by 40 days maximum, tell the ICO about this and also check your account if you paid by cheque if they have taken the payment first if you can.;)
