    please dont accept the good will gesture, go to fos i know you will have to wait but please dont let them them get away with this, this is what they are hoping you will do. at the end of the day it is your money and you have a chance to get all what is due to you

    Hello everyone,

    First of all if you are trying to claim and they are fobbing you off then please persevere. If you give up you could lose a few hundred or a few thousand pounds. At least if you try the only thing you could lose is the price of a few stamps and the time it takes to read through the information on this website and write up some letters. Keep the faith and don't give up!

    Barclays Bank Plc
    Over a year ago we had a claim in against Barclays Bank over a loan/PPI which they eventually paid out on (£5000+)

    Barclays Bank Credit Card
    We have just received a letter from the Ombudsman regarding an earlier claim we put in for a Barclays Credit Card my missus had which she had paid PPI on since 1996-2006 (The account was closed and PPI cancelled in 2006).

    I quote the Ombudsman:
    "You will be very pleased to hear that following our intervention, Barclays Bank Plc has told me that it wishes to offer to settle your complaint on what it describes as a 'goodwill basis' and without any admission of liability."

    This is extremely good news to us and reading through the letter from the Ombudsman they are going to pay out on what we wanted, ie:
    All PPI paid
    8% per year on top of the PPI paid
    8% on top of the total PPI & Interest between the day the PPI was stopped and now.

    My only concern as it does not state it anywhere is how far back will they pay out. Although the card was taken out in 1996 will they pay back the PPI & Interest since then? I have until 7th April 2009 to accept this settlement, but I'm concerned I could get ripped off. Any advice would be appreciated.

    Another part of the letter also concerns me a little. I quote the Ombudsman:
    "As yet we may not have considered your complaint. If you decide not to accept the offer and we consider its merits you should be aware that ultimately an ombudsman may award a higher or lower amount or make no award at all depending on the outcome of his investigation."

    Just wondering if anyone has had a similar experience and what I should consider doing next.

    I'd appreciate any comments/advice.

    Hi there and Well done to you, congratulations.:beer: :T :beer: .

    You could ask the FOS to see if they can get hold of the figures for you, explain you have nothing to work on.

    I note that someone else had this problem on another thread earlier and the FOS told them it may hold or delay their complaint, but yet when my hubby asked the FOS they got hold of the figures straight away from the company, well the following day, it may be worth you asking, good luck,;)

    And your last paragraph is the usual comment from the FOS.

  • Well I have now written three letters, one to First Plus, one to Black Horse and one to Bank of Scotland.

    I have since found reference to three other loans taken out with Bank of Scotland in the past (which have now been cleared) and that had PPI with them so am on the case so to speak....:T

    Also still have to write to Welcome Finance, Direct Line and I think the others re the Bank of Scotland - crazy stuff eh?

    Also wondered......with my credit cards can I still claim back anything on them? I have been charged with defaults and interest charges and late fee charges etc etc the list is endless - I know that is another thread so might just do it anyway.

    God this is so time consuming if it is worth it and we get all our PPI back I think it will have wiped out our debt by at least a half! And I will be a much happier bunny I think.:j :j

But my son gets everything I can give him and he has plenty of things god he is so small his clothes from last xmas have still got tags on them as he is only in 2-3 trousers and 3-4 tops now and he is 4 hehe small is beautiful eh and he keeps me going ....ok time for bed nite everyone and thanks once more for your help and support and I will let you know how I get on with them.

    Wow you have been busy :T :T , well good luck with all these claims hun.

    Yes you can reclaim on your credit cards, ppi on these threads and yes your right in regards of the charges there is a thread for help on these issues on there, but we will try to help all we can here as well if we can in that matter, as with the PPI templates, there are also templates for reclaiming charges on that section as well.

    Goodluck with all of these and reclaim all your late/ overlimit fees on your cards you will definatly get these, probably to pay off any balance on the card but it all helps.x (My middle son is the same, 2 and a half and still in 18-24 month trousers!)

  • Hi all, been a while since I posted here, I claimed bank charges back form LloydsTSB, and won a while ago. Anyway I'm after some advice....

    Using the template letter I requested copies of the original agreement documents from BoS for a loan I took out in 2001 for £12000. I have now received this and looking at the document I see the breakdown is as follows:

    Advance £12000

    Norwich Union C/Care silver? £6357.12

    Interest £7226.76

    Total amount payable £25583.88.........!!!

    How stupid was I, but didnt know any better at the time. This was to be paid back over 84 months but due to a change in circumstances I went on a debt management plan to consolidate other loans and CC due to losing my job etc.

    What I would like to know is the Norwich Union C/Care silver? the PPI I am looking at claiming back, it seems that it is the insurance that I was told i would need in order to get the loan at the time. Also, the interest seems high, for 9.9 APR...???? thoughts and ideas please before i move on further with this claim and if I am doing the right thing.

    hi there, yes that is the ppi, you go for it and good luck, (WHEN IS PPI NOT PPI ? WHEN IT COMES IN DIFFERENT GUISES!!)

I moan, yet again, but I'm still paying this PPI and then I get told I don't have to pay it and it won't effect my complaint / future claim! :eek: So I complain about the FOS and I'm apologised to for the wrong information I was given (on more than one occassion; 3 of which I can remember clearly!) and I'm told that I can take this further if my Barclaycard complaint isn't upheld...
    This morning arrives and I recieve a letter from the FOS stating; 'following our intervention Baclays Bank PLC has told me that it wishes to offer to settle your complaint on what it describes as a goodwill basis and without any admission of liability'. If I agree my PPI policy will be cancelled, Barclays will refund the PPI and refund any interest or charges in respect of the premiums bla bla bla. Which works out about £500 (to my calculations). Now further on in the letter it states that the FOS has not considered my complaint and an ombudsman may award a higher or lower amount depending on the outcome of his investigation.
    So I'm stuck do I accept the offer of goodwill and no liability even though I firmly believe that Barclays were in the wrong?; giving a credit card with PPI to a student (someone who was about to get into massive debt as a result of going to uni) and who didn't have a secure income!

I contacted the FOS and asked for a distress and inconvenience payment because of the distress and inconvenience they have caused me- they said they wouldn't be willing! No surprises... So what to do now- ask Barclays for a distress and inconvenience payment and accept the goodwill or push them to adjudication- what are my chances of them admitting liability?:rolleyes:

    Hi hun

    I am so sorry to hear of this.
    I do not really know if Barclays will do this direct, as its being dealt with by the FOS.

    As I imagine you have a time limit for this, but remember if your not happy this can be looked at further.

    I know many others on here would say don't go for the offer and keep fighting this hun, so you do have a choice here, and in my opinion feel you have a good case here, and of course if there is a big difference in the amounts, then I would keep fighting this.;)

    We support you all the way hun, you go for what you feel is right.:A ;)
