Smitchy, here is the info from the FOS, I do have more info somewhere will keep checking.;)
By reference to the credit card interest that you have paid, I mean only that which pertained to the PPI premiums. Although the premiums are payable monthly, on credit card PPI sometimes it happens that the premium is added to the credit card for a period of time, before you actually make your monthly credit card payment (and you also pay that premium). Hence depending on how this works the PPI premium can attract a small amount of interest charges each month.

    Smitchy and here hun:;)

Essentially the business should refund all PPI premiums you have paid, together with any interest payments you have made to the card while the premiums had been added to your card balance. It should also pay you interest at 8% on the sum, but please note the interest is 'simple' interest rather than 'compound' interest, which means the interest here is only calculated on the sums refunded, and you are not paid interest on interest. This is slightly different therefore to how interest is calculated on your bank current account.

    Hi Di,

Thats great I was just wondering because of the large amount of interest that gets added to the card balance each month, compared to just 8% we'd claim back, I'm looking forward to the mail within the next couple of weeks to see what I get in, this should be fun, wasn't going to go for the charges, but think I will go for them at the same as the PPi charges, ooh I think i'm getting excited, lol.

DI, have you been nominated for a knighthood yet? I think the work you, turboman, maxdp etc do is incredible, is this your day job too?
Thanks to all the competition posters.

    Hi there

When you say they don't have your CCA, how long ago did you take this out hun, if its within the last 6 years they should hold these details on their systems/microfiche, 5 years in Scotland to what I know of.

You could request a SAR (Subject access request), there is a letter template for this on the thread with details, here they have to provide you with everything they have on you again going back as far as 6 years and 5 years in Scotland, but there is a cost of £10 postal order or cheque payment for this request, they have 40 days to comply.

However, it seems they have fobbed you off here.
They must have something in my opinion to have known about you ticking the box.;)
I would ask them how did they know this if they have not got the copy of your agreement, and any problems ring the Information Commissioners Office (ICO) here:
    https://www.ico.gov.uk/Global/contact_us.aspx

They should be able to help and advise you in this case, good luck hun, keep at them.;)

Thanks for your reply! Well the card was taken out in 2004, and the DCA, nor the credit card company can provide me with the cca.

As it was an online application they're saying I "requested it when I applied on the internet for an account with them".
No specific dates mentioned to back this up either in their final letter.

I feel like I'm being fobbed off, but I don't know how best to word a letter (strongly :D ) to get my point across, and ask for my premiums back!

I feel like I'm banging my head against a brick wall with all these applications, and getting nowhere!!

Sorry to hear about your son. I've been stuck at home this week as well with a chest infection and been watching the kids before they go to nursery, arrgghh. I normally work two jobs monday to friday and dont get as much of a chance to get a good read on the site which I love, and because I work in a government office, our new strict internet usage now blocks the forum there too, so can't even access it there, so there has been some benefits to being off!!
I do love this site and there doesn seem to be alot of helpful characters on board willing to be very helpful and for no return other than the satisfaction of helping and getting one over on the banks, lets hope i'll have some cheer as well.
Thanks to all the competition posters.
