    Hi guys,

    This is my 1st post and it may be a little long winded but I need help.

    I'm in the process of reclaiming credit card charges from my partners egg card. When I got the statements out I noticed he had a yearly charge for 'card protection' totalling £150. This is different from PPI, its against the card being lost and stolen however he doesn't remember asking for it and didn't know it was there, therefore I thought I'd try and claim as being mis sold.

    I adapted the template letter for PPI and here's exactly what I wrote:

    " I have just received a transaction list I requested from yourself. Upon reading this I noticed a yearly payment entitled ‘card protection’. I phoned the telephone number on the statement to find out what this payment was for. I am unaware of any authorisation being given from myself for this service to be added to my account.
    Please can you confirm to me on what authority this was put onto my account and also provide me proof of this as I believe I was mis-sold this for the following reasons:
    Having looked at the paperwork for my credit card I now realise I have been paying for card protection that I did not know I had taken out so could not have been explained to me.
    Unless you can satisfactorily justify to me that the policy was fair and reasonable I am requesting a full refund of all premium payments, and subsequent interest on these payments, that I have paid to date. As I believe I have been deprived of this money I also expect 8% statutory interest, the amount a court would award, to be added to each payment made.
    I look forward to a full and prompt response to this letter and for the matter to be concluded within eight weeks or I shall be contacting the Financial Ombudsman to investigate my complaint. "

    I have now received what I think is a fob off letter from Egg. One paragraph states that in my letter the information (template) I used is designed for a monthly Card Repayment Policy etc and in light of that they cannot uphold my complaint. Then they suggest FOS etc.

    They've completely ignored my request for proof. What should I do now? Sorry its such a long post!

    Sorry to hear of your let down here.
    So I take it you received the one and only response including the final response in one?

    Right hun, if you want to move this on to the FOS now is the time to do so, and with the complaints form, enclose a copy of the letter you received from EGG.

    You can download a form from the FOS site or ring them to arrange for them to send one through the post, after you completed the form, get a copy or 2 done, keep one for yourself and send the other to EGG to make them aware you have now complained to the FOS, (sometimes it can help make them change their minds, but do not guarantee this), if they do happen to resolve this then just let the FOS know.

    Hi hun and yes it could be.

    However, if you require paperwork on this to check this out you could always request a Subject Access Request (SAR), there is a letter template for this on the thread with details.

    You do pay a cost of £10 cheque or postal order for this information, as they should provide you will all the information they have on you going back as far as 6 years, or whatever the SAR requests, they have 40 days to comply.

    This may help your case, and good luck.

    When you know this for definate, let us know if you require some help on reclaiming, as there are also templates on site as well.;)

    You could though for the quickest method, ring them and ask them to clarify this to you.

    I have only received the one letter from Egg. Do you think I have a case then? I was worried that because it isn't PPI the FOS wouldn't look at it?

    Can anyone help, I wrote to RBS (Direct Line) in Jan 09 about the PPI on a loan I took out a few years ago. They replied on 11 Feb 09 and said they would look into the case and wrote to me again on 23 Feb 09 to advise that within 4 weeks they would let me know the outcome, if they could not provide an answer I would still be notified. Four weeks expired on 23 March 09 and I have not heard anything? What steps do I take now? Any help is appreciated as always?

    Well I believe you still have a case here hun, so go for it and of course they did also mention the FOS on the letter, so this helps, you will need to enclose a copy of this letter to the FOS as well, go and get em hun.:D :T .

    Hi there

    Once they have been given 8 full weeks in total to investigate your complaint, this is ample time and the timescales they are entitled to, you can now continue your complaint with the FOS now, unless your prepared to give them a little longer.

    I would ring them and ask them if they have dealt with your complaint yet, if they say not, make them aware you will have to consider now moving this on to the FOS.;)

    Just looking for a bit of advice, got letter from F.O.S. upholding my complaint regarding LTSB mis-selling to me P.P.I. on two loans dating back to 1999 and 2000. The adjudicator says that I should be placed in the position I would
    Have been in had the PPI policies not been sold. To achieve this you should pay the consumer compensation equivalent to the total of the monthly payments he has made in respect of the borrowing for the PPP premiums. You
    Should also pay the consumer interest on these payments at 8% per annum simple from the date each payment was
    made to the date you pay compensation.
    The loans were both over 60 months (1) do LTSB have to pay me 8% for ten years and nine years or just the 60 months of the loans term
    LTSB have agreed that the PPI was mis-sold to the F.O.S..
    (2) Do I sign the acceptance form and send it back to F.O.S. without a break down of how they have arrived at the
    Compensation sum.
    (3) Been advised by F.O.S. that getting a breakdown of figures will delay payment of compensation and that if I do
    send the acceptance form back without first getting the breakdown figures they will act on my behalf if anything
    Is amiss with the compensation refunds.

    This is good news, well done.:T :beer:

    See this is the annoying bit - not knowing the amount you will be receiving, I think they should show you the actual figure in order so you know how much you have been offered, so you can then decide.

    My hubby asked the adjudicator last week and he got back to him the following day with the figures, because first of all we did not know what the offer was, and of course it was more or less what you were told.

    I would ask again to see if they can give some sort of idea on this, I think its only fair to know to be honest.

    I have not got a clue with calculations, Turbo who normally works these out is ACE with calculations and would be able to tell you more or less straight away, he should be back soon, but a little busy right now.

    But hun, I would ask the FOS again, and tell them you just want some sort of idea of what to expect, hopefully they can check this out for you.
