PPI Reclaiming Discussion part 4

Hi guys looking for a little clarity on reclaiming my PPI. Started a claim a while back against A&L been with FOS for bout 6 months. Ive come in to financial hardship and i was wondering if hardship was an option for PPI as it is with Bank charges. Also how do i got about getting it resolved sooner seen as its already with the omnusbudman?
Any help would be gr8
Thanks
Hi there
I agree with what Jadest says in the above post.
It would be best to let the FOS know and request for "fast tracking" due to your change of financial circumstances of financial hardship, good luck. The one and only "Dizzy Di"0 -
Hi all - just got a quick query that I hope someone can help with. We are disputing our PPI with First Plus and we have now been assigned an Adjudicator for our case. He telephoned my husband yesterday to ask for additional information and he said that he would now be writing to First Plus for their comments. Can anyone tell me roughly how long it will be until we get a decision as our five years is up in august and if the decision goes against us then we want to be able to reclaim our PPI at this time. However, I don't want to write to First Plus now and ask for money back whilst it is with the FSA. Hope this makes sense. Any advice much appreciated. Many thanks.0

Hi there
Good news this have been passed on to the Adjudicator.:T
Did you have to wait long since the FOS received your complaint, if you don't mind me asking? Thanks as this will give others ideas of what to expect as well, even though I understand they all vary.
Now as soon as its with the adjudicator, it can taken anything up to approx 6 weeks, maybe a little longer if further information is required again.
However, if the adjudicator upholds your complaint in your favour, and FP does not, it may be a case that it will be moved on to the ombudsman himself to investigate.
Hopefully though, yours will be resolved within the first few weeks, good luck here.;)The one and only "Dizzy Di"0 -
Thanks for the response. We sent this off in December to the FOS and had not heard anything for a couple of months until yesterday with the phone call to my hubby. Half of me is quite excited as I feel we have a strong case but the other half is worried that it won't go in our favour!!! Basically its our word against First Plus as the conversation in which we were told we had to take the PPI or no loan is corrupt!!! Does anyone know anything about claiming back the PPI after the five years? What I am concerned about is the matter will still be ongoing once August arrives and we have to write to First Plus requesting the amount back. Will this go against us with the FOS or should I telephone the FOS and explain the situation. Once again thank you so much for all your help.0

I'm sure you will do okay here, FP are the most complained of and the FOS know it.;)
How do you mean after 5 years hun?
It makes no difference at all.
I have been successful with reclaiming a mis sale from a 2001 case (not FP though), and some people even earlier.
Is this what you mean?
Or did you mean because of the policy runs out by 5 years, and FP should pay out on this if you have not made a claim?
There are loads on here dealing with this company, and with FP I do not know what they are like on their 5 year pay outs, but to what I can recall, they are not that good, hopefully someone will post up soon.
I believe "amersall", when she is here later, will be able to give some advice on these for you.;)The one and only "Dizzy Di"0 -
Sorry for not explaining myself properly - i seem to go off on a tangent lol! Basically we would have had the loan for five years in August so we are entitled to claim our PPI back (one of FP main selling points - they even said in a phone call "its like a savings plan!"). Obviously don't want to put the wheels in motion regarding this or telephone them re claiming this back until we get a response from the FOS. However I do remember reading on here a while ago that you have a very short period of time to claim your own money back! Am feeling all over the place today due to the phone call yesterday and have received a letter from the FOS this morning detailing all our adjudicators details. Thank you so much for all your advice. Put the claim in for your premium back as early as you can. If the FOS uphold your complaint they will adjust your redress accordingly to take into account that you have had the premium back.
Therefore if the FOS uphold your complaint and state to the insurer they must refund the premium plus interest, they will actually just pay you back the interest, as you have already received the premium back.I tell ambulance chasers where to go for a living, but am willing to help genuine claimants0 -
