    Blimey they have made a mistake there hun, I would let them know this in writing, take a photocopy to show them, and ask at the same time for them to reconsider the "full amount with the interest" where you were out of pocket (that's if you do not want to accept that other offer), you can as you know always go to the FOS if you want to, but sometimes they will consider moving the amount higher for you.;)

    This mistake of name could also be a mistake in the offer, so always best to check, just in case. Not sure if thats illegal or not but it may be someone elses hubby if you know what I mean and they may have the offer wrong. X

    One of mine in PPI with one company was just under £11K, we received just under £13K back, just to give you some sort of idea. X

    You should get more than the ppi you paid then with the interest etc.;)

    Write back if your not accepting and personally I would not anyway, and defo now if the names are wrong, as it may be the wrong offer.

    We also note the names are incorrect.
    It is possible that another customer have also received an offer with incorrect personal details, and also understand we may not have been given the amount we are entitled to.

    I am writing to request you refund us the full amount with Interest and 8% of what a court would award.
    We have been out of pocket of £XXXX.XX and we are requesting this amount plus the Interest and as stated above the 8% of what a court would award in these cases.

    If your unable to resolve this, we will however consider taking our complaint to the Financial Ombudsman Service to investigate with the evidence to support our case.

    We will appreciate it if you could inform me in writing by 14 days as from this letter.

    Something like this letter will do, it just a simple letter, and you can write anything you feel to help your case.

    Forgot to ask in my last post above, do you send that acceptance form back either way to let them know yes or no?

    If you do make sure you keep a copy of it, in case you need it to show the FOS, with the different names etc.;)

    Thanks Di and Pinknico for your best wishes and thoughts. We have been fighting this for over a year now and unfortunatly I have not got any fight left anymore. Just really upset that we will lose our home. It will be just our luck that we will move out, get repossessed and then receive compo!!! :mad:Might have holiday with some of it Will keep you informed, Thank you

    Thanks for advice.

    I did accept but told them I wasn't happy with their offer. They didn't include the 8% interest which I asked them to do. I'm going to try the FOS.

    I received a letter from direct auto finance stating that the agreement i signed stated all the facts, they also questioned why i was only claiming back now and also said i hadnt provided evidence that the salesperson was pushy. They asked why i was only raising this now. I didnt know I could claim it back until now.. what do i do?

    Hi there

    Do not worry, that is a standard response.

    I would just tell them that, tell them you only just learnt of this in the media and checked your paperwork and realised you have been mis sold.

    So if you already started to reclaim on this and that was the first response and they have not mentioned the financial ombudsman service (FOS) yet, write back and tell them you want this reconsidered because you have only just recently learnt of this type of mis selling.

    If they do not resolve this then you can go to the FOS then, they should give you details of the FOS in the final letter, good luck and keep us posted.;)
