Not sure how this works, but when it is found your PPI was mis sold I am sure the money returned to you will more than cover any arrears and then some.
Glad you are seeing a solicitor, they should know exactly where you stand.

I am writing in response to your letters dated 30th January 2008 and 6th March 2008, with regards the insurance sold with my loan. Your reference is xxxxxxx.

I still strongly believe I was mis-sold this policy for the reasons set out in my original letter.

Although it has been over a year since my original complaint, I have since learned through the media that Lloyds TSB are allegedly deliberately rejecting claims of mis-selling in the hope of putting people off continuing their claim through to the Financial Ombudsman.

I do not feel your letters have offered a satisfactory justification that my policy was sold fairly, reasonably and within my best interests. For these reasons I request that you look into my complaint again.

The Financial Ombudsman has stated that they will investigate my complaint with good reason for the delay, therefore if I do not receive a more favorable response within 28 days I will be continuing with my complaint with the Financial Ombudsman.

Hi, I posted here a couple of months ago about an ongoing PPI complaint. We started the complaint back in Dec 07 and received a final response in March 08. We have since decided to go to the ombudsman but are out of the 6 month period in which you can complain to them (our fault ). Di advised me on the letter above (you might not remember, you help so many people!) which we sent in march, received no reply so resent recorded in april and have still received no reply.

What do you think the next step should be? Just follow through on my threat to continue with the ombudsman and hope they still consider our claim? Has anyone had success doing this out of the six month period? Or shall I follow up on the letter with a phone call or another letter to Lloyds?

    Thanks xx

    Hi there

How are you? and I think I can remember something along these lines.;)

So a fresh letter was sent to Lloyds wasn't it?

Lloyds take forever anyway, and as they do have 8 weeks which they are entitled to, they will more than likely leave it until last minute anyway, it may be worth giving them a quick call and see what they say, if they are not dealing with your complaint then I would then continue with the FOS and hope they will consider with reason your complaint.;)
You did post by recorded delivery didn't you?

Good luck and please let us know how you get on.

  • trying to help bro reclaim from Royal Bank Scotland. He THINKS it was 2004 he took loan out but has NO details. We tried a request as per kind info on here (tho I'd mistakenly posted on successes thread), but they have replied that they need more info (not surprisingly).

Is it alost cause or would the SAR be worth trying? Already printed it out and know about £10 etc.
We're Scotland so think that's 5 year limit .... don't know if worth trying any longer or just futile with no info.

Any advice gratefully appreciated. Thanks :A

    Hi there

There's a good one doing this for your brother, well done.:T

If you get on with this now, he may be lucky to retrieve some information.

I would start by just spending a £1 postal order or cheque payment and enclosing this within a letter to request for the copy of the agreement.
They should supply by 12 days, post by recorded delivery, this should show the loan and PPI details.

An SAR can be done if you want to, as it may come in handy later on, but as long as there is an agreement this should help the case.

If the loan is still active you should find the account number details on bank statements, online banking should show this next to the payments made, or paper statements.

Or in the letter to request this give as much personal details as possible to help them track this down, any different address if different when taking the finance out, and write DOB details etc......
    Hope this helps.

Post up for help when required.

If you know PPI wad definately added, your brother can still continue to send a letter in to reclaim, details with useful info and templates with guidelines below link, they have 8 weeks to respond, let us know how he gets on in case a further letter is required, in case they fob him off in the first response, good luck.;)

Again safer to post by recorded delivery.;)

Have you checked his credit report to see if the details for this loan still show up? xx
