Like yours also with Lloyds, it was crossed like yours, not manually, however even if this was done, this does not mean you don't have a case.
Both myself and hubby have been successful - although it went to the FOS which did go in our favour.
If you have good reason, then go for it, and if they do not resolve this the first time on the first response, write back for them to reconsider, in the final response they should give you details of the FOS, even if it goes as far as them, you should be okay.;)

Just been reading your post and wanted to ask you some advise.
I claimed with Welcome Finance in Nov 2007 and got back responses both times with the paperwork i originally signed saying they do not think i was missold.......so i went to FOS in Nov 07, claim is now 18months old this week.
Based on the information you have provided, does this mean my claim will now be being relooked at with Welcome Finance or remain with FOS?
Also ive read 18 months is about standard for these claims with FOS, do think i should contact them or continue waiting - i have had no corresspondence since a few months after my original claim saying it was in the queue?
Any help would be appreciated?

I'm sure Rosie will reply soon but here's how I think it is working at the moment:
Your complaint will still be dealt with through the FOS. Also it is only the newer complaints that are being dealt with through the new procedures, all of our older cases are still in a queue. Yours seems very old though and from what me and Rosie have gathered they are working on cases from January-February 2008 so I would definately give the FOS a call and query this and it would probably be worth speaking to Welcome Compliance to find out if they had heard anything from the FOS and to query if they can help you at all. This is the number for the Welcome Compliance Dep: 0845 6187 804 and the FOS is: 020 7093 5500.
I hope this helps, as I said before your case is very old so fingers crossed you can get this sorted.

A friend of mine took out a loan from Lloyds TSB and was sold PPI put was not told.
He recently showed me the agreement and I advised him to cancel it. He was told he could not do so.
He was also unemployed at the time and has lower back problems.
The copy of the loan agreement clearly shows the PPI calculations but he is unable to read and these were not pointed out and explained to him at the time. He was not shown or given a copy of the T&C for the PPI.
He is in the process of sending the first template letter which states that he did not realise that he was paying for the insurance and was not told that this was included in the loan.
Could anyone confirm if this is enough or should he also point out that he is unable to read english and was unemployed at the time?
Any advise will be appreciated. Thanks0 -

It seems quite clear that he did not know what he was taking out so it looks as though if has a strong case especially seeing as he had health issues anyway. He can cancel the Loan PPI but will have to refinance the Loan you cannot just cancel the PPI on a loan as it is not stand alone but included up front on the Loan including interest.

Thanks Di, I think I have a good reason in that the salesman was very pushy and suggested that I would not get the laon without he PPI, however, I'd have trouble proving that.

My hubby has a pre existing medical condition and could not make a claim on this when he was from work.;)
It may be a good idea to request a Subject Access Request, known as an SAR, the link below is a template letter, they must provide everything they have on the SAR going back as far as 6 years in England, and Wales, Scotland 5 years and so on, they must comply by 40 days, but there is a charge of £10 postal order or cheque payment for this request.

Post by recorded delivery to ensure your letter reaches them, you can track it down on the "tracking" of the Royal Mail website.;)
Hopefully you may receive something useful within the SAR to also help your case, if this goes as far as the Financial ombudsman servicce (FOS), if you want to end up taking this direction if they don't resolve this for you.
The main of Lloyds complaints are resolved through the FOS, but saying that recently I have read much success direct.;)The one and only "Dizzy Di"0 -

In regards of Cap One:
Have you any old bank statements, or do you bank online, if so you can always try tracking your account number down if you paid monthly out of your own bank, the account number is normally shown on the payments, if not you can always try requesting for a copy of your agreement which should take about 12 days to arrive to you.
But you will need to write in your full name, if the surname was different then and the address, also write in your DOB, they should be able to track this down, but well worth checking on old bank statements first.;)
If you request for a copy of your agreement, enclose a £1 postal order or cheque payment for this request and as always post by recorded delivery.
Yes I believe Cap One where one of those who were fined for mis selling PPI.;)
