Oh dear, so they gave you an option, yet they did not pay this where you wanted this???
If there are no arrears, then I think in my opinion its only fair for you to have your choice here.
They should not have mis led you.......:mad:

By them offering that option and then not granting it, I think thats miss-representation.
I did phone the FO and they agreed if they gave me the option to pay direct to my bank account, and I choose it they should do it. They also said that their action is caurse for complaint.
If they dont uphold the settlement form I think I will complain to the FO. Apart from this under handed thing it took them 3 months to admit miss-selling.0 -

Your right I'm as mad as can be.
I have composed a letter to them which I will post by special recorded delivery first thing in the morning so they get it first thing Tuesday.
I will keep you posted on any progress. Knowing how these companies can manipulate things for thier own gain I'm going to need all the good luck I can get.:cool:0 -

After signing the settlement form and ticking the box for my refund to be paid into my bank account ( I had 2 options to credit my card or credit my bank account) I posted it off to them recorded delivery.Today 1 week later I had letter back from them saying;
" I note your acceptance of our offer and your account has been credited. Unfortunatly, it would not be possible to refund the amount in question to your bank account as you hold an outstanding balance. Accordingly our refund has offset this balance."
How wrong is this, surely if they gave me 2 options to choose from they should uphold the choice they gave me, and not withdraw one choice when it suits them.

I think I remember something about it being written into the small print that if you have two accounts with one bank - if one has money and the other not - they can transfer any time they like but it SHOULD be some sort of breach of contract. It's YOUR money they're refunding, not their's they shouldnt be able to dictate to you what you do with your property - right or wrong. I can't understand why they think we should be grateful for returning money to us they obtained illegally - if it wasnt obtained illegally, none of us would be able to get it back - right?
Which is why it's best to have two banks. They hate that - have a name for it "split banking". Tough cookies I say - its this kind of thing that forces the ordinary person to take a less then desirable decision (for them that is). If they bothered to have a relationship with their customers - that is, actually communicating before they mess you up - they would keep them. They havent made the equation that loyalty (like respect) is earned.
To challenge what they've done, you'd need someone in the know - possibly legal. I'm just a lay person0 -

If my letter fails I will try the FO as I have already spoken to them.
I dont bank with Barclays, so my bank account is quite safe from them. I hope!0 -

hi thank you to DI3004 and AMERSALL, i have looked into this but the thought of going through courts scare me. my husband is now being made redundant and my wages wont pay all bills and mortage. so i need to get my back side in gear!!!!! i did try with one loan company a few months ago, they said the account was finished so i'm not entitled to anything back, IS THIS TRUE? THANKS AGAIN.I SPOKE TO A WISE OLD MAN THE OTHER DAY.
