    Ok then Stereo Mike can you please give me some inside info? What chance have I got in re claiming for a loan that was taken out in 2001 and completed in 2006. I was most definately miss sold as I wasn't actually aware I was paying ppi. I've discovered that Hartwell were not governed by the FOS or FLA - what would be my next move?
    hi there - did you see my post in response to your earlier question ?

    Hi it would be Hartwell you pursued as they 'sold' the policy to you, however, as the policy was sold in 2001, that's 8 years ago and the Statute of Limitations Act 1980 limits the claim of a 'debt' to 6 years. As Hartwell weren't covered by the Financial Services Authority you couldn't take your claim to the Financial Ombudsman, but you could start proceedings in the County Court. If you do you unfortunately run the risk of Hartwell applying to have the claim struck out as being 'time barred' and as such you run the risk of losing the claim and having to pay the defendants costs - which won't be insubstantial !!!

    Thanks for that. I was just wondering if anybody has had success in claiming for a loan that was taken out in 2001? Does the start date apply and not the fact that it was completed in 2006? In addition I wasn't aware that I was paying ppi on the loan until 4 years in when I lost my job and fell behind on payments. It was the call centre girl who told me I should try claiming on my insurance, which I did but was rejected - and yet they still continued to charge me ppi whilst I was unemployed!
    Who would have governed Hartwell Finance back in 2001 if it was not the FOS or FLA does anyone know?
    Hi - no one governed Hartwell back in 2001 that's the big problem !! There is a clause in the Statute of Limitations (Clause 32 which Marshallka mentioned earlier I've just seen) which says if you've just been made aware of the debt / issue the judge has the discretion to allow the case to go to court - but again you have to be aware that if you start proceedings and Hartwell put in an application to have it struck out due to being time barred (all applications go to a hearing before the proper claim hearing is set) then even if you win that application with the above mentioned clause you still may have to pay their costs for both their attendance at the application hearing and any preparatory work they undertook !!

    Also, as you're claiming mis selling unfortunately, it goes on the date of sale

    Just as a matter of interest - why did they reject your insurance claim in 2005 ?- if that's the case at the very least should have happened was your insurance should have been cancelled - you would therefore, have a valid complaint and should be able to reclaim the premiums you continued to pay after the insurance claim was rejected !!

    After signing the settlement form and ticking the box for my refund to be paid into my bank account ( I had 2 options to credit my card or credit my bank account) I posted it off to them recorded delivery.Today 1 week later I had letter back from them saying;
    " I note your acceptance of our offer and your account has been credited. Unfortunatly, it would not be possible to refund the amount in question to your bank account as you hold an outstanding balance. Accordingly our refund has offset this balance."
    How wrong is this, surely if they gave me 2 options to choose from they should uphold the choice they gave me, and not withdraw one choice when it suits them.
    What do you think

    Oh dear, so they gave you an option, yet they did not pay this where you wanted this???

    If there are no arrears, then I think in my opinion its only fair for you to have your choice here.
    They should not have mis led you.......:mad:

    I would be angry to be honest, especially as they did ask you about this first !!
