    If you believe the policy was mis sold to you (in otherwords you don't want it or it doesn't cover your circumstances ) when you make your claim tell them the reasons you were mis sold but also state you want the policy cancelling immediately, but be aware that if you were make redundant you won't have that type of insurance covering you - I think when it says you 'can't claim' it means you can't claim on the insurance NOT you can't reclaim if mis sold

    I have had my letter from the obudsman saying they agree with my complaint and that 1st plus should pay back my PPI..
    Which is fantastic, but there last letter said if 1st plus hadnt been in contact within 6 wks to the obudsman back. Do I contact 1st plus to push them as its been 5 wks or wait for the 6 wks to expire then get the obudsman to sort it...

    Hello All, I have been having a bit of trouble with Bespoke Finance. I took out a loan in 2004 through Freedom Finance, which was processing on behalf of Bespoke Finance, even though GE home lending actually financed the loan. I have written to GE,who replied and told me to try Freedom finance, then two letters to Freedom, who told me to contact Bespoke, and two letters to Bespoke later, and at last a reply from Bespoke Finance! Break through! Well They say that they haven't mis-sold PPI to me, but I'm following Martin's tip's and hopefully we'll see what happens next. At least them even responding is something I guess!

    i got the same letter i got mine so i would wait another week i think they do actually have 8 weeks good luck:beer:

    Hi there, this is looking good then.

    I would leave it all to the FOS as FP will more than likely say its being dealt with directly with the FOS now anyway.

    Hi

    First of all I hope i'm posting this in the right place. I couldn't find the link for a new thread!

    I took out a loan in Feb 2008 for £10,000. To obtain the loan I was told I had to take out (I think it was payment protection but could have been a package that included travel ins etc - I suffer with memory)
    I made 4 monthly payments of £256.02.
    I paid off the loan in July 2008, was surprised to see £10,096 balance. I questioned this and was told I had to pay the insurance/package off in full.

    I then came across this website and sent the 1st letter template asking for my loan agreement. I recieved a reply within a week stating -
    "Under the Consumer Credit Act we will act on a s. 77(1) or s. 78(1) request if the regulated agreement has not ended...........As the loan has ended we have no obligation to provide the information you request."

    2 questions, 1) is this correct? and 2) What is my next action?

    Any help will be greatly appreciated.

    just posting with a quick update. Got a letter yesterday from WF denying that I had been mis-sold and saying they are correct and no PPI or interest or charges will be refunded. They claim to have telephone calls asking me if I wanted PPI and I said yes and also twice they told me it was optional so what do I do next. I have already sent a letter to the compliance dept and they seem to have sent it the same day I posted it.:mad::mad:

    also have referred it back to the FOS as they went past the 8 wks. so any suggestions as to what to do next as I dont think I will get anything back now

    have also posted this on the WF thread am really fed up now

    All that i can say about these two companies is that Freedom say they process loans on behalf of Bespoke and then pass the buck as they have with you. You then have the problem of the loan and PPI was 2004 you need to find out if Freedom Finance was regulated by the FSA for insurance at that time and then you have to make them legally responsible for the sale. This will be difficult because Bespoke will actually ADMIT the sale to you. You would then have to use the courts too for whoever you are making the claim against if Freedom were not under the FOS jusridiction at the time of your sale as I know for definate that Bespoke were not. I am sorry to have not been of any further help but if you look back to the start of this actual thread there is some information about making the lender responsible for this. I do not know anything about this myself and then again were GE actually regulated at the time as well as this again would be the courts if not. :confused:
