PPI Reclaiming Discussion part 4

Despite seeing how inept they can be at times, I was totally astonished to be told that I was outwith the timescale for the PPI issue. I hope the facts comes through clearly on that. If they don't reconsider this, then I have no option but to go to court over the PPI matter, but I'll certainly be raising a complaint with the FOS if they still knock this back as being outwith the timescale.
The really annoying thing was that the letter said something about, "We've consulted with the Bank and they do not wish to drop the time bar in this instance.............." yet the first I hear of there even being the suspicion of a time bar is now. Why contact the bank about a time bar then tell me that time was even an issue? Now they would have go back to the bank and say, "We think we got the timescales wrong." Would the bank pay out after that or is it not more likely that would contest any decision over the time issue? A complete balls-up I think and if it needs court action, then fine, they'll get court action, but not before I've went through the complaints that the FOS for dealing with complaints about themselves.
Still raging.
Have not had time to read up all on this matter bathgatebuyer but I noticed that you write about "comsumer credit" (CCA) complaints and FOS. FOS can look into anything about consumer credit providing the agreement was taken out after 6th April, 2007 when they have jurisidiction over anyone with Consumer credit activities.
For the ombudsman to be able to help, complaints about consumer credit must relate to an event after 6 April 2007 - and consumers need to have raised the problem first with the business concerned. From this weekend, all businesses with a standard consumer-credit licence must by law have formal complaints-handling procedures in place - to try to resolve any problem before the ombudsman gets involved.

So, from start to finish it took a total of 3 months and 8 days from me sending my original letter to their final confirmation letter arriving yesterday. I only wrote one letter and they have done the rest. Can't really argue with that!
This is a strange one. Today when I checked my current account I found I was £600 odd better off than I should have been. Turns out that Bank of Scotland have paid the money into my bank account rather than my loan account. The funny thing is, my current account is not even with Bank of Scotland!!! So after telling me that they had to use the funds to reduce my loan account and after everyone telling me that I should query that, they have paid it directly to me after all!
The only problem I have now is that I have £600 that I am not sure what to do with. Don't get me wrong, there is plenty I could do and would love to do but I don't want to fritter it away. Should I use it to reduce my loan anyway? Should I put it towards my mortgage? Should I put it in a savings account? I don't really want to spend it unnecessarily because I will just end up feeling guilty. The only debt I have now is my loan and my mortgage. Or should I just go all out and decorate my daughter's bedroom like I have been promising for the past year (obviously there will be money left over from that)? Or should I put it towards a well deserved holiday? Heeelllllpppp!!

OK so I wrote to my Natwest CC asking for PPI to be refunded and they received a recored delivery letter 7 weeks ago today. They have written twice since then, once acknowledging that they have received letter and this is the name of my case handler and a second letter after 4 weeks saying that he was not able to complete his investigation within 4 weeks but would be aiming to complete within 8 weeks.
So I am expecting to hear back in the next week either with a response or another letter saying we are still investigating.
What I was wondering was - if I get a 'we are still investigating' letter should I write back or hold fire?
When should I send the second letter (if at all) - should this be sent exactly after 8 weeks?
Thanks in advance for any help.

Wow, a holiday sounds very tempting.
However in my own personal opinion mortgage wise, it would have to go on that, yet everyone circumstances are different.
You do what you feel is right hun, if you can manage a holiday then go for it.:D;) well done XThe one and only "Dizzy Di"0 -

Hi Stan
8 weeks is more than ample time for them to investigate.
I would contact them and ask what sort of timescale are they looking at, realistically anytime after 8 weeks your entitled to move this on to the FOS.
I would give them your own personal timescale and tell them if you do nt hear by that date, you will take your matter to the FOS.
Good luck though and hope you hear soon with some good news.;)The one and only "Dizzy Di"0
