    I'm sorry if I've posted on the wrong part (not used to these forums yet)

    Anyway in 2003 I took a loan out with Lloyds TSB the loan was £5000ish, last year I paid £1000 off the loan - it left me with £190 left and I noticed that Loan Proctection had been included which I knew nothing about.

    I phoned the bank and got through to one of these call centres - I was told that they did not have copies of my loan agreement as they didn't keep them and I must have signed for it. I wrote a letter of complaint and heard nothing, that was in December.

    I phoned them back a few weeks ago and was told they had not received my letter although the would contact the complaints department.

    Yesterday I got a letter stating that my case would be investigated and I would hear something within 8 weeks. I have since found my original letter in which I said I though the insurnace had been mis-sold to me as I knew nothing about it and it can't have been explained properly which I have sent off (again!!) but this time recorded delivery.

    Has anyone had a similar experience? Does anyone think LLoyds will help??

    You lot still here? :D I'd thought you would all be millionaires now with yer ppi claims :p

    Bit of a tricky one but hope someone can advise ;)

    I thought everything was going well so far, have a few claims with FOS and waiting patiently for their response however at the start of February Monument wrote and offered just over £1k for ppi charges and all they wanted was a letter of acceptance.

    Of course I swiftly wrote back but in the past few weeks OH been contacted by Lowell, a DCA saying they now own the debt. I wrote to both Lowell and Monument for a CCA request just to see who owned the debt as there was no sign of the ppi refund on the account.

    Monument wrote back today with a rapid reply card (their answer to a CCA request :rolleyes: ) and printed terms and conditions that could be anyone's and at the bottom of the letter informing OH that debt has been passed to Lowell's and contact them in the future.

    No sign or word of the refund for ppi, so what is my next step? Lowells haven't responded to my CCA request yet and they wouldn't have a clue about the ppi would they?

    Hiya Toffee Penny, hope your well and yeah we are still here lol :D;) .
    Now that would be nice to be millionaires, like the sound of that one lmao :rotfl: :rotfl: , maybe one day......:D .

    Did the FOS say to contact them if you have not heard within a certain timescale, like 4 weeks for example?
    If not I would let them know anyway, I know they close their files but they do as far as I know re-open them on cases like this, if nothing received in a reasonable amount of time.
    I would let the FOS know as soon as you can, or maybe suggest to the FOS that you write to them with a letter before action.

    I did have the proper template for a letter before action (LBA) but don't think I saved it silly me, because when me and hubby won the Nemo case through the FOS we pestered Nemo for the refund, it was something like, if we do not receive the refund within 14 days of this letter, then further action will be taken (or considered), something like that, and it worked, but the FOS asked for a copy of this for their records, so always go through them first.;)

    In regards of a CCA request they should supply these to you by 12 days of you requesting this, tell them if you do not receive this in the next few days you will contact the Information Commissioners Office. (ICO), they should sort them out and get in touch with them for you.;)

    Hope this helps hun and hope the FOS can push this one for you, file closed or not, they still dealt with it and as far as I know its not officially closed until you have been paid out and the money is right.

    And welcome.;)

    I hope you get a good outcome straight away hun, my experience and many others in regards of lloyds, its standard to receive a fob off response first time round.

    Write back to them if this happens, keep on at them until you receive the final response, you will then have the opportunity to take this to the financial ombudsman service (FOS) if your not satisfied with the outcome of this.

    I did post something on here it was either yesterday or the day before, of media news of both lloyds and northern rock, Lloyds unfortunately rejects at least 95% of these complaints, where most end up with the FOS, then almost all then are successful.

    So just keep on at them hun and post up anytime for any help, good luck.;)

    I am more annoyed it will take more letters to sort out, I'd thought it was all sorted when Monument offered a refund but I feel they have acted really sneakily doing this to avoid paying out.

    Should I pass it on to FOS and let them deal with it or write again to Monument asking for a cheque refund for the ppi offered as the debt has seemingly been passed on? Their offer letter was their final response but we never stood a chance in getting a refund as they passed it on immediately it seems.

    Is it a long drawn out process for all of this? (sorry never complained to a bank before) and do you, in your opinion think I may have a case???

    Hi Toffee Penny, not too bad thanks and you, hope your okay too?

    Even though I know how this must be so frustrating for you.

    Personally I would still let the FOS know, because they were dealing with your case, they should still look into this for you and in regards of the CCA, you could now contact the ICO if the 12 days have passed, details here of the ICO:

    This will take some pressure off you at least and let them deal with it, I'm sure Monument will budge then.;)

    Yes you definately have a case.

    Even if you did sign for this at the time, like myself, I signed because it was not explained to me and I thought it was all part of the finance.

    So keep at it, I'm sure you will get a good outcome at the end of it.;)

    You've given me some hope! I had no idea how or who to complain to and I was a bit annoyed that they never replied to my first letter.

    Anyway hope it sorted out soon.

    Yeah I'm fine now Di thanks, just had to have a break from here for a few nights.

    Debt busting and ppi fighting takes it toll especially on the life off screen. As much I as I enjoy chatting to people on here, time just seems to disappear when you on the net doesn't it? :D OH just doesn't get computers so feel it has been all me since December the start of our ppi fight and it takes its toll; the knockbacks, researching the net for creditors responses for ppi etc

    It is very frustrating when you don't read the words you want in creditors letters but I feel lucky with what I have achieved so far with just a few letters. You get really impatient though at times don't you? not good for your health at all getting stressed all the time, eating, sleeping ppi reclaims.
