  • How did you do it? Thank you so much gumbi for this post you have given me more information than the FOS and FSCS together. Feel so much better now that I have a better understanding of the situation. Very happy lady!:T

    They have responded to my MP's enquiry and explained that the workload at the FSCS is roughly 10 times that of 18 months ago, hence the delays but I have been assured that they are changing their systems to be more focused on the consumer and make sure that we're all kept informed.

    Watch this space if you're dealing with the FSCS!

    Hiya everyone,
    I was wondering if you could help me please!
    I sent a request for loan agreement details to claim back ppi charges to HSBC & RBS.
    This is now over 40 days ago. I have yet to receive a reply from RBS.
    On Friday I received a call from HSBC basically saying that they couldnt find any of my details - or loan agreement and suggested that I went away and looked for it myself. I know I do not have a copy of this any longer. They have not formally written to me about this.
    Can anyone offer any help? Im a little stuck now as to what to do? Do you think this is just a stalling technique?!

    Hi Hayles

    Sorry to hear of the messing about you've had.

    Did you actually request for SAR (Subject access request) and pay £10 cheque or postal order to cover the request, and of course they have 40 days to comply.
    If so did you post by recorded delivery, and if you enclosed the payment - if cheque, have you checked your account to see if they have debited this?

    Some companies are more lenient than others and some give the info free of charge but you cannot guarantee this, although if you SAR them with a payment by law they should provide you with the details of the SAR by 40 days of request.

    If its just the agreement you require at this point, write to them and enclose a £1 postal order or cheque payment, they have 12 days to supply this to you, again post by recorded delivery, so you have proof of posting.

    It you live in England and Wales, they should supply everything going back as far as 6 years, if they still do not comply you can contact the Information Commissioners Office (ICO) explain your situation and they will or should deal with this for you.;)


    I am having trouble with the link that normally works for the ICO, will add this anyway, it may just be down, or it may even work for you, keep trying and hopefully it should come up, if not I will re-post when its back on again.

    i think its disgusting the way some of these companys react, and i am appalled with the response of hbos. do what di says, and then take it all the way with fos, this is just another delaying tactic by the banks. please dont give up, its your money
