    Hi, am new to the forum but have been reading with interest the PPI threads. I have just sent off the questionaire to MBNA for Virgin CC and today have sorted out the same for an old car loan through Shogun finance/LTSB. not sure if I'll get anywhere but have been inspired by your posts. When I looked at my Credit Expert report from several yrs ago I had 3 Halifax loans at some point, vaguely remember, found all the paperwork. The earliest is from 2002, what do you think my chances are? I bank and have my mortgage thru them so hopefully when I ring on Monday they will be receptive to any enquiry!

  • Hi Cappo, thanks for taking the time to respond. On the paperwork I have for the loans there is only a breakdown of loan, total credit, insurance loan etc no tick box or any opt out descriptions. At the bottom there is a line ' We will use the insurance loan to pay the provider of repayments insurance' As these were from so long ago I cannot remember conversations with regards to the cover. My question really is how does anyone think I should approach the call to Halifax. Any suggestions would be much appreciated.

  • Hi I was hoping someone could give me some advice please before I send back paperwork/claim form for my mum.

    My mum bought a car on finance in 2004, the car was bought from ford but the finance agreement was with GE Capital Woodchester.
    We have the original agreement and she clearly did not tick the box for PPI.

    However my mum became sick in 2004 and when she called to inform the finance company that she was sick and could not work and may struglle with payments, she was informed that she had payment protection. (these payments had been coming out of her bank seperately to car payments and from a different company) She was informed that she could make a claim and her car payments were made for a period of 12 months.

    Although this claim was made can my mum still claim that PPI was missold as she did not ask for it in the first place as it is not on the original agreement and its only by chance she found out that she was paying for it.

    Also if she had wanted PPI she would never have taken out something that only covered her for a 12month period!

    your help would be much appreciated, also if the above does not make sense sorry!

    Hi Martha this is a tricky one, you can still claim misold and people do but you have
    made a claim and the cost of the claim will come off any win But you have a good reason there as you never asked for it, see links below

    thanks for you reply and the information.

    It is a tricky one. Another issue we have is that the premiums were still coming out of my mums bank account for the 12 month period that the loan was paid for and we have letters from the insurance company stating that the premiums were being covered by them??? Also at the time my mum questioned why it was only covered for 12months and the insurers said thats the way it was! Im not to sure how to approach this one and think I need to tread carefully when filling the application, but thanks for your help.

    Yes it doesn't make any sense does it? This is standard pretty much with these policies thats why most of the time a standalone policy is better.

    If this was £1 you can only request a copy of the agreement,they have 14 days to get this to you.
    Just to let you know,if an account is closed,they do not have to provide you with a copy of the agreement.
    If it is a Credit Card copy agreement you want,the ppi may not have been put on until you activated the card,so the agreement may be of no use to you.

    If you want all info that a bank has on you,you need to send a SAR to each bank with £10 per bank,this will throw up all the info you need.

    If anymore apply to you then let them know.

    They will still look at the complaint,and you may win redress,but to be on the safe side see if anymore reasons apply to you.

    they didnt say it was opitional
    and i was pushed to take it before they proceed on computer .
    im sure i said that to them when i phoned them , along with saying i was told i had to have it. to help me to gain credit ,
