    As a result of this review, I am satisfied that the only issue that arose with the sale of the PPI attached to your personal loan was that if your single premium policy was cancelled early you would nbot receive a pro rata refund because of the way that we calculate the cancellation of the PPI policy
    Did you not complain for mis sell with the ppi being front loaded and what other reasons did you give for mis sell? they are upholding this on the basis you were not happy that if you cancelled this ppi you would not get a pro rata refund,if this is the case and you feel you were mis sold this policy then get back to them,if you were mis sold this,you should get the ppi taken off the loan and the payments you made returned to you and the loan reset.
    If they wont look at this again,you need to reject the offer and go to FOS.

    Hi many thanks for your reply, No I wasn't aware the loan was front loaded, however I do remember sitting in there for hours arguing that we didn't want the PPI, I remember what the people look like and have their names from business cards. I am phoning them tomorrow to cancel the PPI. But this one is for alot less than the other claim I sent in, yet I haven't heard nothing from that one as yet, They will try to say its because its from 2005. Even though it was them that told me I can claim off that one. So I don't want to agree or sign anything until I have received the other one. As I will sign away any rights to claim against them for other PPI. I think lol my poor head :rotfl:

    no breakdown of loans without ppi , so does this help prove ppi was pushed on us . as i told hailfax it was .

    Do not cancel either of the ppi,stick with the mis sell as if you win,you get all the ppi back that you have paid to date and not just a portion like they are offering you,plus the loan reset.
    You want full redress and not just a pro rata refund.
    Use the single premium reason for mis sell too.
  • Hi, I am looking for some advice really. I sent off 5 claims to Black horse about mis sold PPI. Friday I received the news that 2 had been upheld but 3 hadn't (which i will get to later as 1 of these was sold to me by the same person as the last 2.) Black Horse took me to court on the last loan as it was a secured loan and I am currently struggling to pay an extra £100 a month on it. I don't quite understand the paperwork that they sent though to me as it is for loan 4 which was finished when I took on loan 5 which is still live. I think that this should clear my arrears but the question is really "will the court order still stand when they have agreed that the PPI was missold?" I am not great at this and as I didn't send in a SAR I do not have all the payment details I need and I don't want to hold this up any longer if it will sort the arrears out as they have been threatening repossession. i hope this makes sense to someone, Many thanks.

Just that MBNA sent me the PPI policy and that has a number on the top but I do not think it's personal to me....it looks like a generic font to the rest of the document!

    Hi tracy the generic number is probably the reference number and yes the section of the fos form that asks for the policy number is the loan account number or the credit card number.:):):):):):):)

    Hi kim i'm sorry to hear about all this stuff going on, i think you would be better speaking to a member of cab about this as you need very specific advice to your own circumstances and i would'nt like to advise you wrongly.

    For those who ticked the box (cos you thought you had to!) I've also found out (after trailing through MBNA's T&C's) in paragraph 12b it states:-

    "If you ask us to arrange insurance on your behalf we will treat this as your authority to ADVISE ON and manage any insurance policy for you"

    Surley if you ticked the box it is then the business' responsiblity to uphold their own T&C's. If they have not ADVISED you then the business has not done the job as set out in their T&C's and the policy is not fit for purpose!
