    Hi

I decided to try and reclaim old PPI after success with my mortgage exit fees last year thanks to MSE.

I had two old loan agreements with Dell and DFS which stated I had ppi so I sent off the FSA claim forms and copies of the agreements on 7 Jan. I have had no response to either.

I obtained copies of my Experian Report and sent off letters with requests for my agreements and cheque for £1 to MBNA, Argos, Egg and British Gas.

MBNA responded with a copy of the Agreement, it must have been submitted over their phone as there is an "X" where my signature is and the PPI box is unmarked so I am assuming there is nothing further to do on this?

With regard to Egg, they responded requesting updated address details which I provided. Today the wrote to say under Section 78(3) of the CSA under section 78(1) they don't have to provide me with a copy of the credit agreement. I looked on the forums and I am going to send a SAR letter in response to this.

I haven't received any response from the other companies.

Co-incidentally I received a letter from Northern Rock today asking if I wanted to claim on the loan I have with them. I actually had PPI on it and a couple of years ago I claimed and they re-jigged my payments and gave me a refund of the PPI I had paid. Can I claim again?

Sorry its a long post but I do appreciate your valuable advice.

    Wendy
I have answered your post on the other thread.

We took out a secured loan with Firstplus and were missold PPI insurance. We tried to claim it back but they have refused to pay as they say we went through a broker who no longer exists. We are still paying the loan and every thing we have ever paid has gone direct to Firstplus and all communication has come from Firstplus. Can anyone advise are they right about this or are they trying to hoodwink us!! Thanks

Who was the broker, and what year did you take this loan out?.

DIAMOND LIED when he said "no quibble" refund on PPI.

He did not,the no quibble was for all ppi claims put on hold before the JR.
  • What information do I need to take my complaint to the FOS? My claim was rejected by Black Horse and despite a number of emails to Geraint Griffiths, customer services etc, since November, I have had no response at all. My partner is self employed and due to illness has been unable to pay the loan concerned for a year. BH have never offered the PPi to help with the payment. We did not ask because we thought we did nt have it as we knew it was not an option for self employed. When I rang for a settlement figure I was told we had been paying PPI. So I claimed for a refund. They replied as follows:

As a result of this review, I am satisfied that the only issue that arose with the sale of the PPI attached to your personal loan was that when your single premium policy was cancelled early you would have incurred additional cost at the time you closed the account. This is because you would not have received a pro rata refund because of the way we calculate the settlement of the PPI policy. In addition, as you did not recieve a pro rata refund, your borrowing for the subsequent loans would have been higher than it needed to be. Yadda yadda yadda.

They offered us a refund of £23.22. The PPI cost £5000.

    Any help gratefully received.
  • Hi everyone,
Just thought I would share this with you.
I wrote to CT Capital (previously Central Capital Ltd) at the end of September using the templates from this site.
I got a response from them on 3rd October acknowledging my complaint stating they would make a decision within 8 weeks. 7 weeks later I received a letter stating they would need more time as they needed more information from the company, who were not forthcoming with the information requested.
On December 15th I received a letter from CT Capital stating that they would not be responding to my individual concerns as they had decided to uphold, in full, both my complaints!!! Result! I have to wait until March for my money (not sure why??) but will be paid £787.20 and £5684.37.
One letter was all it took, very surprised and delighted.
Much appreciated and if like me you are wondering if you should, just do it.
Thank you very much Martin & Co!

If this was the final response, then they will not deal with you,get advice from FOS,this was a single premium added to the loan, this was a mis sell, had you known you had this, you would have made a claim against this.
Tell the FOS you are not happy and want this to be addressed,if you can think of any other reasons for mis sell, put those too, enclose copies of all correspondence between you and the bank .
I cannot believe they have blatantly put " your single premium ppi" this is the most upheld of all ppi,the FOS wont like this at all.

Look here for other reasons for mis sell and if there are anymore that apply to you, put these in.

To save you time, tell FOS you will download the questionnaire from their website and post it off to them.
  • Hi, well following 2 succesful complaints against Lloyds for my wife netting about £5,500 I'm turning my attention to loans/credit cards I've had in the past.

I've put a claim in for MPPI I feel I was mis-sold and now waiting for a decision but I had a loan with Tesco which when looking at the paperwork I see was front loaded with PPI. In addition I took out the loan when I had been working for an employer for only 5 months and still in the probationary period. At the end of the probationary period (6 months) I would have been entitled to a minimum of 6 months sick pay, 2.5 times death in service and worked in an industry where redundancy was very very rare.

I guess my question is does the fact I was still in a probationary period and only employed 5 months make it likely that I wouldn't have been eligible for the PPI if I had to make a claim at the end of the probationary period.

On top of this I was led to believe (via a phone call) that I stood a better chance of getting the loan if I took out the PPI but cannot substantiate this so am looking for other reasons to go with the complaint.

Thanks for any advice anyone can give and thank you for all the information that is available on this forum without it we would never have had the courage to make a claim!

    Hi mikeandbec,
Front loaded PPI is frowned upon and is a good enough reason to COMPLAIN not claim. You are complaining that it was mis sold, the fact that you were on a probationary period at work may have meant that you were not covered but without seeing the T&C's it's hard to say. Go with the upfront reason as this has a good success rate. It was a loan within a loan and you have had to pay interest on it for the full term, keep us posted and good luck ;)
    Successes
    Sainsbury's/BOS £6,400 Paid :)
    MBNA £3,600 Paid :)

    Hi lisajaynec,
The total figure will not be much more than the £208.57, I would hazard a guess at £220. Not a huge amount but a WIN :T and it's better in your pocket than theirs ;)

Can i ask how you work it out please.
i had a ppi loan from hsbc that paid me £2500, granted that was a £5000 loan but not taken out until 2001.
Thought I might at least get £800 with the 8% as it was from 1995 -is it not 8% year on year.
Thank you for taking the time to reply
