Hi
Im new to this site. I used the template letter to try and claim PPI on a Mortgage with Alliance & Leicester. I wrote to Santander who didn't reply. I wrote again sending the letter by recorded delivery. I got a reply saying they could not trace any Mortgage related/covered by the Cumsumer Credit Act 1974, and sent my letters back with my £1 cheque, i'm not sure what my next step is. Can anyone please offer advice.
If this mortgage is paid off they dont have to provide you with a copy of the agreement, you could send a SAR,this will cost you £10,but you should get all your info.

If this mortgage is still running,i would have thought they would still have the info?.0 -
Hi all,
I was just after a little bit of advice as having recently having read all the PPI success stories. I thought I'd drag all my old statements out. I found that I have potentially got 2 claims, the first being with First Direct for a Credit Card, I've had since 1998 and only just realised that I'm paying PPI on and a second Credit Card with Capital One which I had a few years ago but I could only find the original agreement which is the tick box type that meantions insurance and another letter about 4 years later stating that the insurance has been cancelled at my request, but I've got no statements whatsoever for Capital One. I would not have agreed to either PPI as I'm covered by insurance which I pay for through my employer that ensures that I receive full pay for 12 months should I be off. Therefore I'm wondering what the best course of action is with regard to making a claim. Should I apply for copies of Terms and Conditions for First Direct now and a full breakdown of my account for Capital One now before I make any claim or should I just register a complaint now and worry about that stuff at a later stage? I'd be thankfull for any advice you have to offer. Ben0 -
All you need are the card numbers and reasons for mis sell to make a claim.

Thank you for your quick response amersall. I knew that I could make the initial complaint without having all the statements but I was wondering on a tactical basis whether to apply for a SAR as I've no idea how much PPI, I've paid over the years and being a bit cynical. Wondered if the companies might not be as helpful with the SAR once a complaint is lodged? For instance after the complaint has been lodged whether Capital One may say that they've lost my records or been archived etc0

You could do SAR as you may get all the info you need, but if you request this the chances are they will know why you want this,so your logic works both ways.
When ppi is redressed on a Credit Card, they go back 6 years, unless you have proof of ppi paid before this,so go the SAR route and hope you get all you need.0 -

Hi jnrcop, If you look at my success above I only had one statement and the account number to go with but it appears that they have gone back at least 6 years. I am totally surprised at the amount I have recovered. I was expecting a standard "here's £1200" at the very most. No SAR requested or previous statements asked for by myself. All I knew was I was paying PPI from the one statement and I didn't ask for it or need itSuccesses

Cheers for that dilus, I hadn't seen your post. Thats really good result. You've made my mind up. I'm just gonna lodge a complaint and I'll see where we go from there. And thank you for your advice amersall, I hadn't thought of it from that point of view.0

Well, well... I received a copy of a Credit Agreement from Argos card services today, an account opened 10 years ago. I opened the account in store and the application was completed by a store assistant.
Looking at the agreement, I must have declined PPI and signed the paperwork... there is a 'yes' 'no' selection, I must have said no and signed and left? Well the credit agreement has the 'no' scribbled out and the 'yes' ticked!
Does this mean that I have a good chance of getting something back? I have already filled in the FOS questionnaire and will send with a cover letter tomorrow!
Sent the same to MBNA on Monday, waiting in anticipation!0 -
