So my next set of questions for you... firstly with regards to capital one, I was charged PPI, I know this without doubt for at least 6 years on a credit card. They have photocopied the paperwork and sent me it, I have read through it and I havnt ticked a box or signed anything with regards to having ppi but I definitely had it on the account the only mention of this is within the long list of Ts&Cs(number 12 out of 24 - 6 pages long) I sent capital one a letter last week as they hadnt responded within 12 days to my original request, stating if they dont respond within 21 days I will take this matter further. My question is basically, what would be my next step? Now I have received the documentation (they crossed in the post, it wasnt sent in reply to my second letter)
Also. At the moment I have only gone back to 2005 with my claims but I have read on here that going back further is possible - just how possible? I know I had at least one dodgy loan when I was younger and pretty sure I would have had others with PPI on them but how do I get the information? Do I just ring up HSBC for statements from that time?
Capital one is the most important thing for now though if someone can answer, much appreciated.
{Edit} I just noticed a box for optional insurance which was never ticked nor signed.... what now?
You didn't tick the box,thats a good start !
They will probably come back and say you signed up in a phone call when you activated the card or similar.If they do then ask for the transcript of the call and push them on every point they make,make them attempt to prove you signed up.Keep going until you get redress or a final response from them.
If a final response and refusal is the outcome and they won't communicate further then you go to the FOS.0 -

hi i had a cap one card for bout 6 years from 2002 to 2008 during the time i had my card i had ppi it was charged depending on the amount on my card the more credit the more ppi i was charged the thing is i dont remember taking this ppi out and i know i did not recieve any terms and conditions in writing i still have most of my statements do i have a case?i was cgarged hundreds of pounds in total for a ppi plan that i never realy wanted or needed any advice welcomexxxplz help0

Well after having success with Sainsbury's/BOS and better still being paid I have unearthed a 20 year old credit card that is still in use (was used quite a bit 3 years ago when moving house) and it has PPI included, so I am putting in a complaint tomorrow and will let you know how it progresses.
Started off as Alliance and Leicester and is now MBNA, nothing to lose and will FOS it if not happy with response;)
Sent in complaint 22 Dec 11 received acknowledgement today 9 Jan 12 saying I will get a response within 28 days. Here's hoping for the right resultSuccesses

CAPITAL ONE AGAIN ???? It is difficult to know how many people this disgusting bank scammed, it's all coming out now. Why the FSA issues a credit licence to them beggars belief ???

I received a check for my missold ppi by Halifax. I put this into my current account. Money had come out of my credit card balance. When it cleared in my current account it reappeared on my credit card balance. OK i reckon I get this but I had a deal for low interest on my balance. The cleared check has gone back on at the high current rate. Is this right? It certainly doesnt foster goodwill.0

The wife had a loan some 8 years ago with Barclays that included PPI. What I am intending to claim against them on is that she had 4 products with Barclays, all with separate PPI, she was never told she could take PPI out elsewhere or that it was optional consequently, she ending up having 4 individual expensive PPI products with them all running in parallel!!
We've already complained successfully to Barclaycard on the two credit cards, but am unsure as to what can be claimed on the loan? All I have that details the history of the loan is a full transaction print - I've been chasing Barclays for MONTHS and MONTHS for full info but neither them nor the ICO have come through, Barclays are being very obstructive.
why are they being obstructive?,you have the account number dont you,on the transaction print?.
I'm tired of trying to obtain full details and am just wondering whether I can run this lot by someone to see if I can work out what our full claim amount should be instead of playing Barclay's game.
On the statement, initial transactions were for 15000 (the loan) and 4098 (the PPI), she made payments of 322 for 19 months before settling early for roughly 16,000 so a total of 23k in payments, interest charges were roughly 160 a month.
Given the final settlement, I'm thinking the PPI might have been front loaded? Would that mean I can reclaim the full amount? What about the interest charged? Can I claim the ratio of interest charged against the PPI? So PPI / loan x interest charged? Finally, 8% on top for every year since?
The refund will be the £4098 (this included interest) less any rebate they gave for early settlement.plus you get the 8%,if you had loans that were settled with another loan,then ask them to look into these for you,just put that you would like all loans relating to this to be looked at.
The loan and interest were not mis sold so you dont get this back.
Appreciate your help, tired of playing games with Barclays and am surprised that the ICO have been extremely unhelpful, would like to just get this sorted now.
Look here for reasons for mis sell and put a claim in if any/all apply to you,you only need the account number.

i hope you all had a peaceful xmas and a good start to the new year.
I don't know if anyone replied to my last post; things have been more than a little difficult over the last month or so, and sadly that includes the ppi rebate situation. I'll be totally honest and say that i'm completely exhausted from this process; the guy at the fos who's dealing with my case may still be on holiday and norton finance have not followed the ombudsman's instructions that my loan repayments should be recalculated, and subsequently ge money are potentially just 14 days away from serving a default notice. However, could some kind soul please tell us if our understanding of the following part of the ombudsman's ruling is correct.
The part we're having trouble understanding reads:
"norton cannot require x to reduce the loan beyond that which would now have applied had the ppi not been sold"
does this mean that regardless of how many times my sister has paid the monthly instalment of £261.15 (including ppi) when the monthly amount without ppi would have been £216.88, whatever excess she has paid over the last 4 years will just be disregarded, and only now can she expect the monthly instalments to be £216.88? Or does it mean that since 48 payments of at least £216.88 had been paid, the difference between that figure and the £25.63 in ppi each month would count towards paying off the outstanding balance? It is very upsetting that we cannot find anyone who will help us understand this, and ge keep phoning and demanding more money than is owed. The loan agreement clearly states that without ppi the interest wiould have amounted to £3,009.20, yet my sister has already paid £11,334, but norton claim she still owes £3354.20. We really don't understand. Please help.0 -

i'm not quite sure about this. Ge money informed us several times in 2011 that when the ppi had been taken off, the loan would take less time to clear. Then in october 2011 we were informed that my sister's payments were completely upto date, and the outstanding balance was £3354.20. This was before the ppi was taken off and the fos decision was passed. Yet norton wrote to my sister after the fos had ruled in her favour, and told her that the £3354.20 still remained as the outstanding balance after the ppi rebate. The original loan agreement stated that without the ppi the interest to be repaid over 60 months was £3,009.20 on top of the 10k loan, yet £3,637 in interest has already been repaid after 48 months of repayments. The interest is the real crux of the problem as if the loan had been sold without ppi, by my calculations that means that £3,009.20 interest should have cost £50.15 per month, with the 10k costing £166.66 in capital repayments. Yet because of the ppi the initial sum even before repayments commenced rose by nearly £500 rather than the £150.45 it should have, and interest each month started at £101.30 per month and didn't get anywhere near £51.00 until january 2011. I've checked every single one of my sister's payments to ge and having deducted the cost of ppi each month, she has repaid £11,334 already. But the interest on the account has increased the outstanding balance dramatically every month, which nobody appears to want to acknowledge.
