hi , my first post so thanks in advance.

got a copy of my original agreement with capital one which does show i never ticked the little box to purchase PPI but have been paying for it . whats my next step .

So you never agreed to the PPI but they added it regardless. Capital One are well known for their fraudulent activities .... AND IT IS THEFT AND FRAUD under the Fraud Act 2006

Tell them you never agreed and why have they stolen money from you.
Demand a full refund plus interest or you will take them to County Court

i left the little box unticket , tbh i never knew i was even paying it until i looked at a statement a couple of months ago
  • I took out a Cap One card purely as an emergency card back in September.
Talk about a hard sell on the PPI when i activated it,i was saying no for at least 15 minutes before the sales girl gave up.I reckon 50% of people would have caved in just to keep her quiet.
First thing i did when i got my first statement was make sure it hadn't been added regardless !

Hi everyone, hope you are settling into 2012 ok

2011 was a year of learning all about these thieving banks. The latter part of the year showed just how devious these cretins really are. Making excuse after excuse not to pay and then they had the "brainwave" to use the FOS as a "breakwall" between you and the bank creating huge delays with the already overworked FOS

This is what we must do in 2012 ....
WE DO NOT TAKE PRISONERS -- DO WE ?

In 2012 we will whip these banks into shape. If you get a letter saying " go to the FOS", reject the letter if you believe you have a strong case and that being, you do not agree, you were forced into the PPI, they stole your money, you were sold a fraudulent policy. the policy was not explained to you, the policy would never have covered you.

Then give them 7 days to make you an offer which is suitable to yourself. Failing that, you will issue a County Court Order against them which will then include your costs.

This is indeed history repeating itself if you remember the BIG reclaim on eroneous bank charges. Very few banks turned up at court and if they did, they lost anyway. You will obtain judgement by default. If they do not pay within a couple of weeks, you can send in the bailiffs to get the money or seize goods.

The time for waiting months to get your money back is over, the law is on your side and you must use it against these fraudulent banks.

DO NOT BE BRUSHED ASIDE BY THE BANKS, they have damaged you and make certain this year, YOU DON'T GIVE THEM AN INCH TO MOVE

LET'S FACE IT, IF SOMEONE STOLE YOUR WALLET OR PURSE, YOU WOULD REPORT IT TO THE POLICE. They might not catch them but at least we all know where the Bank's H.O is ?

Thanks for that, I am sure many people fall under this pressure magic.

With these pressure sales people there are many ways to put them off

1: Keep saying PARDON, did not hear you .... HELLO HELLO

2: Put the phone next to your TV's loudspeaker, maybe TV Burp will be on and they can enjoy the programme with you

3: I had unsolicited calls from an insurance company, I kept saying no but the calls kept coming. So one night, a lady phoned despite me saying no more calls ....... I listened and then said " tell me, you are a blonde slim lady ?" Yes she said, oh good I said, and started to make grunting noises down the phone. There was silence and all of a sudden she said "you filthy pig" ??:rotfl::rotfl::rotfl::rotfl:

Never heard from them again :T:T:T

Then there are banks who like to use Mumbai in india to chase debts ??
BARCLAYS AND MNBA ARE THE MOST POPULAR
Not only can you not understand a word they are saying, they don't really speak english ?
"Darling, I think its the Indian Takeaway, what you do want ?
OK, 2 Prawn Madras, boiled rice, mixed veg and a couple of nans please"

    BE AWARE ...
Banks who give your details to call centres they are using as an agent and not 100% owned by them are in breach of the Data Protection Act and any such call should be reported to the Information Commissioner’s Office

  • I received a check for my missold ppi by Halifax. I put this into my current account. Money had come out of my credit card balance. When it cleared in my current account it reappeared on my credit card balance. OK i reckon I get this but I had a deal for low interest on my balance. The cleared check has gone back on at the high current rate. Is this right? It certainly doesnt foster goodwill.

Not understanding, you got a cheque which was paid into your bank account .... how then does it appear on your credit card ?

The wife had a loan some 8 years ago with Barclays that included PPI. What I am intending to claim against them on is that she had 4 products with Barclays, all with separate PPI, she was never told she could take PPI out elsewhere or that it was optional consequently, she ending up having 4 individual expensive PPI products with them all running in parallel!!

We've already complained successfully to Barclaycard on the two credit cards, but am unsure as to what can be claimed on the loan? All I have that details the history of the loan is a full transaction print - I've been chasing Barclays for MONTHS and MONTHS for full info but neither them nor the ICO have come through, Barclays are being very obstructive.

I'm tired of trying to obtain full details and am just wondering whether I can run this lot by someone to see if I can work out what our full claim amount should be instead of playing Barclay's game.

On the statement, initial transactions were for 15000 (the loan) and 4098 (the PPI), she made payments of 322 for 19 months before settling early for roughly 16,000 so a total of 23k in payments, interest charges were roughly 160 a month.

Given the final settlement, I'm thinking the PPI might have been front loaded? Would that mean I can reclaim the full amount? What about the interest charged? Can I claim the ratio of interest charged against the PPI? So PPI / loan x interest charged? Finally, 8% on top for every year since?

Appreciate your help, tired of playing games with Barclays and am surprised that the ICO have been extremely unhelpful, would like to just get this sorted now.
