PPI Reclaiming Discussion part 4

Thanks to all who helped me resolve my PPI reclaim with First Plus, Turboman especially for the number crunching. We have accepted offer, got requested 8% stat interest and awaiting cheque. Hopefully a settlement figure will show an amount that can be paid off with a personal loan or re-mortgage so can say BYE BYE to them forever.
I hope everyone else gets success and can't believe they are dragging heels with others when our claim went quickly and smoothly! Good luck everyone else.
Emma
We still do not understand what the resulting balance of the overall loan will actually be--post up exact wording/figures when you get the revised loan Balance/new pymnt so we can verify our calculation mrthods

I recently placed claims with the above, please please read the small print. I have had an offer for one of my credit cards for 175.00 but will only recieve
50.00, they charge a min 125.00 for each contract they sucessfully win... Also note that if your refund is less then there min charge you will have to pay them, don't do any claims via these companies if the refund is not expect to be considerable. Min 125.00 charge, or 10%+vat+interest on what you are awarded
It would be intetresting to here if anyone else has had the same shock as me, that way I don't feel such a fool.0 -
I am starting the process of reclaiming ppi premiums for an MBNA credit card I have had since 1995. I am not sure how to word the letter as I seem to recall that I never spoke to a salesperson and if I did agree to the insurance it would have been a case of me ticking a box on the form I sent in.
MBNA cannot provide a copy of my original agreement and I don't have it. Can I claim I was missold because nobody gave me advice in person?
Hi There have you sent a SAR letter to them?
I would expect that the box on the agreement was pre ticked meaning that you had to opt out of the PPI. MBNA can be very stubborn. I have had to take my to fOS and my complaint has been upheld.
Anyway try the SAR first and they will then have to send you all information that they hold on you.
It is not for you to prove that it was miss sold it is up to them to prove that they did not miss sell it to you.:mad:0 -

I got a letter from FO saying i was getting back full refund from RBS of all premiums paid, plus interest plus 8% which is what ombudsman would award... Fab yes!
I got the refund within 8 weeks promised and i decided to ask them for proof of how it was calculated. What i got back was a load of rubbish pages missing not explaining anything. So i took it upon myself to work out what it should be and low and behold they have shorted me easily few hundred quid. I have just finished my letter of complaint for them to put it right. Il let you know what they say.
Be careful with refunds check they get it right they are dodgy!!!!!!
You are quite right in warning people The FOS can only advise these companies they do not check the refunds. One of mine that was refunded they still have not supplied full figures and that was back in July. I have now had to compain in an official manner. Anyway well done for that warning and hope it gets sorted for you quickly.:T:mad:0 -

I wrote and asked them for a copy of my original agreement and the ppi premiums I have paid. They say they are unable to provide a copy of the initial application form and sent me interest statements going back to 2001 totalling £1245. Presumably they no longer have my application.
Hmmmmmmmmm well as far as I am aware they should keep all paperwork for 6 years from the time the agreement ends.
Saying that in those days people were not on the bandwagon of claiming back and filing clerks made mistakes and lost paperwork etc.
Anyway I would suggest that you reply to them re-iterate your complaint and make sure they realise that you did not willingly ask for this insurance.
Tell them that you are willing to take the complaint to the FOS give them fourteen days to reply. You can then download a form from the fOS web site and send in your complaint.
Be aware that these complaints can take up to I would guess 15 months at the moment. Good luck to you and post again if you need further assistance.:D:mad:0 -
Hi All,
Thanks for everybodys help and advice particularly Di3004, just though id keep you updated. Sent my initial reclaim letter to Lloyds/Halifax and Capital One on 09March, to date have had replies from Lloyds and Halifax saying they are looking into it but havent heard anything from Capital.
Not sure if it went to the correct address, I sent it to
CAPITAL ONE BANK PLC.
PO BOX 5281
NOTTINGHAM
NG2 3HX
Should I wait until the 40 days is up before sending next letter? If it has gone to the wrong address should i resent original letter again and would anyone know what the correct address is??
Many thanks xx

hiya
Im hoping that someone on here can help me. We have just won back my OH PPI from 2004. However he also took out a loan in 2001 with a PPI.
This was with Natwest.
Is there a deadline for how far back you can claim PPI's back as he was mis-sold with for the same reason as the 2004 PPI - that being the medical condition catergory.
Thanks to anyone that can help usSealed Pot Challenge - No 1520Want to be debt clear by June 2012:j0
