PPI Reclaiming Discussion part 4

Hi hun
Personally in "my" view I think its worth another try, and if you have more reasons to add you can if you want to do that as a brand new complaint, and mention you are hearing more and more of this mis selling in the media all the time and you feel strongly let down which is so unfair that this matter was not corrected and resolved.
So you can either go for a brand new complaint.
or
Carry this on and tell them you have not continued with this within the timescale due to personal reasons, but know you were mis sold this by learning more of this in the media recently and feel you have rights to have this resolved.
Go for it hun, I'm sure we can try other things out if this does not work.;)
Just to add if they do decide to investigate this and do not uphold your complaint, you should then be able to take this to the FOS again, as the loan company did investigate X
Good luck

Thanks again for your replies Di,
what do you think about this:
Dear Sir or Madam,
Re: Account number: xxxxxxxxxxxxxxx
I am writing in response to your letters dated 30th January 2008 and 6th March 2008, with regards the insurance sold with my loan. Your reference is xxxxxxxx
I still strongly believe I was mis-sold this policy for the reasons set out in my original letter. (Shall I re-print these?? Cant hurt I suppose?!)
Although it has been over a year since my original complaint, I have since learned through the media that some companies are deliberately rejecting claims in the hope of putting people off continuing their claim through to the Financial Ombudsman.
I do not feel your letters have offered a satisfactory justification that my policy was sold fairly, reasonably and within my best interests. For these reasons I request that you look into my complaint again. If I do not receive a more favorable response within 14 days I shall be taking my complaint to the Financial Ombudsman.
Thanks!

Hiya hun
Yes that is great hun. Well done.:T :T .
I expect they may want a little longer but they should let you know but at least that way you know they are looking into this matter for you.;)
If you did start this as a brand new compliant then obviously they would need the 8 weeks as the normal timescale.
You could add on the letter that the FOS have stated you can go back to them within good reason, (in case they try to fob you off due to not continuing with this last year), you can tell them due to some personal issues last year, I was unable to continue with this complaint where the FOS will consider investigating within good reason if not resolved.
That bit it up to you hun, but great letter and go for it.:T
Good luck and please keep us posted.

Sorry to keep bugging you, but would you mind giving this a once over?
Im just a bit worried; I always stick to the templates, this is the first time I've ever really written anything in my own words, even though Im currently working on 13 various reclaims!
Ive changed the time frame to 4 weeks, a middle ground. Ive also added, as you suggested, that the FO may look into it regardless.

The Financial Ombudsman has stated that they will investigate my complaint with good reason for the delay therefore if I do not receive a more favorable response within 4 weeks I will be continuing with my complaint with the Financial Ombudsman.
Thanks again!

Warning...........check your refund
I got a letter from FO saying i was getting back full refund from RBS of all premiums paid, plus interest plus 8% which is what ombudsman would award... Fab yes!
I got the refund within 8 weeks promised and i decided to ask them for proof of how it was calculated. What i got back was a load of rubbish pages missing not explaining anything. So i took it upon myself to work out what it should be and low and behold they have shorted me easily few hundred quid. I have just finished my letter of complaint for them to put it right. Il let you know what they say.
Be careful with refunds check they get it right they are dodgy!!!!!!MY Successes = RBS PPI, RBS bank charges, Aqua PPI, Aqua cc charges, HFC PPI, Welcome Finance PPI, Blackhorse PPI Mums Ongoing= Swift Advances PPI, London Scottish PPI, Blackhorse chgs, GE money pyts missing

Hi Di
All 5 loans were taken out and settled in the last 6 years, only one still running. I did have the documentation so was able to check the refunds were correct. 2 were Direct Line and 3 were RBS. They have settled 3 in full and the other 2 I sent to the FOS. Both Direct Line loans were sold by telephone and the the 3 RBS loans were sold by a Customer Advisor at the branch which is why it doesn't make sense that they have paid out on 1 DL and 2 RBS. They only sent me documents for the 2 loans on which they made the £750 goodwill gestures.
They made the offer and settled in Feb 2009.0 -
I am starting the process of reclaiming ppi premiums for an MBNA credit card I have had since 1995. I am not sure how to word the letter as I seem to recall that I never spoke to a salesperson and if I did agree to the insurance it would have been a case of me ticking a box on the form I sent in.
MBNA cannot provide a copy of my original agreement and I don't have it. Can I claim I was missold because nobody gave me advice in person?0
