    Thanks, I think I will - I dont know whether to wait on their initial settlement cheque or just send the damages letter now?!

    If I send the letter prior to receiving the cheque for the PPI will they just cancel it?

    Worse still, if i cash the cheque...can they then say "Well you cashed it, so now you cant claim damages"

    Yes it is a bit tricky as a cheque is normally paid out as a full and final settlement so you could'nt go back to revisit the amount as it were but i would think that with additional compensation they might have to send you a new calculations letter out which might delay things and the banks would almost certainly use any delay to there advantage, it's a tough one to call.

    Hi these are two different issues.

    One is reclaiming the mis-sold PPI, the other is claiming damages from them due to the mis-sold PPI and the damage it caused you.
  • FOS asked me to complete (again) the original paperwork I completed off this site which I sent back on 22/09/11. They acknowledged receipt on 29/09/11 and then sent a further letter dated 01/10/11 stating that it could be anything up to a year before I get a result due to the volume of complaints.

    Have to say patience is not my strong point. I've sent 3 emails now for a progress report; presumably my hands are tied now and I just have to wait?

    Hi karen sorry to hear about these new delays my cap 1 is all done now, time to start on LTSB, good luck on this once the fos get into it you should be ok, i had an adjudicator who came in near the end for me at the fos, absolutely excellent, fingers crossed you get him.
