During the internet sales process info re PPI appeared on a separate screen to your card application. it would have been clear from this seperate screen that ppi was a distinct product from the cc.
this option to tick the box would have made it clear that you could choose to have it or not. given that you ticked the box, i am satisfied that you actively chose to purchase ppi and that it was optional when you did so.
Then it goes on to say that you were eligible as you were 18-70 in full time employment and lived in uk. then says i have reached the view that given the circumstances the ppi policy you purchased provided cover which would have been beneficial to you.
Then it goes on sorry to disappoint you...................
then fos
Firstly she was employed and had sickness cover by her employer, she lived with her partner (who she is now married to) who was also in full-time employment and they have no dependants.
She staes that the internet box was pre ticked....but cant prove it, so thought it was compulsory for the card
But MBNA sent out a photocopy of the form to sign which she did sign and returned confirming ppi.....
She was going to leave it but I think its worth another go and then off to FOS if no joy. Any help gratefully received
Thanks
Further information is that she thinks she received the policy but hasn't got it now and never claimed on it. She says that the form was
pre-ticked but with pen as its different to how her hubby writes ticks. The copy that they sent her had the ticks already on and also crosses of where to sign-which he signed and returned.
Any help writing a letter or pointers even would be gratefully received
Thanks

hi all - wonder if someone can help?
I had a reply from Tesco Bank decling my complaint even though i was made redundant last year and they never offered the use of the PPI but suggested a payment plan instead.
Anyway sent them a letter asking them to look into it again and reconsider but not heard anything back for 4 weeks or so. Tried calling the 0141 331 2366 no but its always engaged - anyone have an email or alternative no for them please?0 -
quick questions, I am looking to claim for mis sold PPI. I remember at the time of taking out the loanI was told I would need PPI as If I died, my mum and dad would be liable for my loan. This was for an unsecured loan.. would I have a case?
Thanks0 -

As i was currently still paying my loan they advised this would be paid off and any monies over the amount i would be owed. i was advised to continue paying my monthly payments and this would all be settled and paid back) ( im owed from July onwards!!!)
i rang Barclays middle of October for an update on this reclaim as i had not heard a thing! i was advised that Barclays have 40 working days to pay out from time of settlement figure.
This would of taken me to the 8th november, and guess what still no payment!!!!
There customer service is shocking , i was cut off a number of times and constantly put through to the wrong department! Im currently on Day 2 of waiting for someone to call me back!
The longer they are leaving this the more money they are owing me!!!
Any one else having these issues with Barclays or is it just me???
It its very sad to say, but the CEO of Barclays, Bob Diamond LIED about the "no quibble refund policy"
Barclays have now turned into a BAD BANK with rude ignorant staff.
Guess it is another bank struggling with its finances and with the volumes of claims, dont have enough money now0 -
Now heard a rumour over the road that all online credit card applications that have been done online or by post are being rejected by the banks and the fos now, i will try to get more info on this and come back on and post shortly if this rumour is substantiated which as i've said it isn't yet.0

Hello all, hope this is in the right place ( not great with forums or pc's ).
I am hoping to claim ppi for loans and CC for my partner. He's dyslexic and even worse than me on a pc, lol. He's had several loans from Yorkshire bank, he thinks about 7 or 8 from '98' onwards and has no paperwork. I wrote asking for terms and conditions using the template, but put his current account number on top of the letter, ( was that wrong?). Anyway got a letter back yesterday saying
We note the acc number you have quoted refers to a current account.
Section 78 of consumer cred act 1974 gives borrowers the right to obtain a copy "of the executed agreement (if any)". Overdrafts on a current account are exempt frm the need to comply with the documentation requirements of the act under a determination made under S74 of the act.
The overdraft facility is referred to in the terms of your current account plus conditions and is created when you draw down that facility. Accordingly we consider that there is no executed agreement to be provided under S78.
I trust that is satisfactory, however, should you have any further queries pls do not hesitate to contact us at the above address.
I don't understand the letter and am feeling a little but thick because of it !!! Can anyone help please??
Btw, you guys on here do a great job, it's only from reading posts on this forum that has given me the balls to do something about it.
I wrote the SAR out lastnight should this be my next move??
Ps. My partner also has had a visa with Yorkshire bank ( still running), he's had it 16 yrs with ppi, Would the SAR have details of this also if I put the account number on the top of the SAR when I send. Many thanks.

Hi karma why are they mentioning the overdrafts as it is the loans and credit cards you want to claim on, i'd call them, initially i think it is the bank being a bit thick not you, all these banks seem to be suddenly developing collective thickness and amnesia, if you still have no joy then sar them as if you have lots of loans that will be the cheapest way to get your account numbers for your loans and credit card. your loans in 1998 would have been front loaded so i think you've a fairly good reason for claiming.0 -
Re: Latest Update on PPI Judicial Review - NO APPEAL - get your claims in......
Quote:
all credit card claims now done through post and internet and being rejected and are then going on to be rejected by fos, dont reckon the banks will have to pay out as much as they have provided for, unles there is self employed or pre existing medical condition you dont have a chance and fos wont back you up
I don't like the sound of that, MBD - can you tell us the source of that info.
