Hi everyone
im new to this so please bear with me! and apologies in advance if this has already been asked but after reading Martins article re PPI i just have a couple of questions:
1. can you reclaim PPI if you still have your loan/mortgage etc with the same company
2. can you reclaim PPI if the loan/mortgage if you still owe the company money (eg i have years left on my mortgage/loans) but have been with the same company since i took them out).
3. do you need a copy of your original agreement to begin to make a claim

OK heres an upadate on what the Halifax are telling me now.
They are trying to get through the complaints as quick as possible, but it can take up to 12 weeks for a final response letter and then a further 30 days for a payment to be made. I questioned the final response letter and the girl told me that this is the letter with the calculations on it and not the acceptance letter which I recieved in August. She also added that she cannot put timescales on any individual claim. When I asked about the status of my claim she said it was still in the calculation stage.
If this is true my letter should be here next week as I am in week 11 now with an outside chance of getting my money before xmass!! Then again maybe not! But at the very least the Halifax have improved they customer relations in comparision to the 'theres a backlog, we cant give timescales' that they were coming out with every week for the past 2 months when I was calling!!!0 -
Received letter 14th September which stated as a 'goodwill gesture'?? they are making an offer of £6,805.33 to be paid in 28 days, I accepted the same day.
26th September another months payment taken from bank,
17th October received another letter saying because of high volume being received they are having delays of potentially 4 weeks, so e-mailed them complaining and told them was cancelling DD,
21st October they tried to take another payment....Have since had 5 letters asking for payment (I owe £4, 800 to my mind that puts me £2k plus in credit) and late payment fee's....
I have attempted to call the PPI number dozens of times it rings for 15mins then cuts off, have called the number they quoted for the late payment, when you tell them its actually me thats owed the money they pass you round telling you its another department, have written to them and I have never had any acknowledgement from mails or letters, not surprising I suppose as it never happened in the two years I was writing to get to this stage.........
Is there anyway you can actually get to talk to these people or do they just ignore everything and think they can get away with it???????

Hi Just another update, in previous thread ,I recieved my cheque from BOS.
The Halifax actually rang me on Monday, lucky I was home The lady asked if I recieved my cheque and was I happy that it was here I told her that I was appalled that I had to email the CEO 10 times to get a payment, she said there is another payment due to me from another card Marbles and she would get on to it for me , she rang me back 20 mins later and said that halifax will pay me out for this card (unbeleivable I know) but it would probably take 6 weeks because the marbles team have to send the info to the Halifax, this is a claim that I could get nowhere with, infact I gave up.
She said that the CEO's email were being dealt with by her and another person.
My Hubby got a letter Saturday morning saying his cheque is being processed and he will recieve it this week .Plus £50 for extra interest and any phone calls he has made.
This is only after I begged him to email the CEO which he did 3x times .We have both been waiting since May5th .
The lady also told me that Loan PPI is being paid quite quickly because the paperwork is not so time consuming as the Credit card PPi checking statements etc.
My advice is do not give up, keep emailing the CEO of the bank of the Bank they have to react to this type of complaint.

Halifax / LTSB made a lost of £3.5billion so they dont have the money ?
The CEO Antonio Osario went on sick leave for stress, he knew what was coming. The acting CEO, Tim Tookey leaves LTSB in february so they don't have a leader right now.
Issue a formal complaint to Halifax HO with copies to the FSA, FOS and your local MP0 -

Hi Please email the CEO (old sicknote) and you will defo get your calculations letter speaking to an advisor is a waste of time and effort.

Hi I have already emailed CEO twice and got a letter a few days later both times which was bascially what the advisor was saying but in writing. As for my local MP, I live in Northern Ireland and dont think he would be that interested TBH, our politics is a bit differen to the mainland, but is there anyone on here who has actually contacted an MP from NI.
I have long since accepted that it will come when it comes (but will still ring next week if i havnt recieved my calculation letter as by then they would exceeded their 12 week period. They have inadvertently created a timescale even though they say they dont have a timescale by stating 12 weeks!)0 -
I'm new to the forums for forgive me for breaking into a discussion. I just wondered if a limited company which was sold ppi when taking out a loan, could reclaim?0

Write back and ask them to provide you with the evidence of the phone call, state they must still hold these details to have come to this decision to reject and you will appreciate they send you a copy of any evidence in concrete of the phone call that proves what they say.
Anyway, back then many assumed it was all part of the package because not being told it was optional in the first place, then assumed if to cancel that the full balance was to be repaid in full.
Again because the staff that sold it to you failed to explain the policy and how it worked, and yet if explained to you that it was optional you would not have taken it out, and if known it was optional at the time.
Tell them the sales staff failed in providing you with a clear explanation of the policy and it was their duty to do so and certainly not yours.
Hope that helps, ask they reconsider by 14 days and if they do not change the decision go to the FOS and the same if nothing heard by then.

many thanks, sorry for not replying earlier I've been waiting by the letterbox for my MBNA cheque (not here yet) am going to email them today with your advice, I'll let you know how I get on, my gut tells me that they have nothing or they would have sent itbut we'll see

I understand that MBNA are giving new delay tactics now, they say the cheque has been sent and give a date ?
There must be loads of cheques from MBNA floating around the Royal Mail ????
