DH is saying they told him he had to take PPI and Nationwide are saying he chose to have it. DH says he was very upset at being told he had to take it at the time and felt cheated. The Ombudsman says there's no proof either way and no recordings available of the phone conversation.

The law says that he who asserts must prove. That doesn't mean you must gather all the evidence but it must be more likely than not that your version of events is true and not just equally likely. This would apply equally if a claim was made against you.
DH is most upset. He said it honestly wasn't about the money so much as the cheek of Nationwide and he feels sad that a big company like that have got one up on one of us.

Neither the person investigating the complaint nor the Ombudsman will know because they were not involved in setting the policy up. They also know that not all complainants are entirely accurate in their recollections.
Very sad. I do also wonder if it might have been a different story if we'd put in a claim now instead of 3 years ago, as I know a lot of banks are paying out more these days.

Only if they are in a hurry to meet FSA deadlines.

Thank you so much for your reply. On the PPI box on the leaflet, the final sentence before the box states, in bold print, "We strongly recommend that you take cover by ticking the box."

That sounds like a recommendation to me.
The store assistant, as I recall, handed me a card application leaflet with some boxes already marked with a cross in biro, for me to fill-out with my address and bank details. I am as certain as I can be that the PPI box was pre-ticked, as it is so different to the way I normally write an "x"

That might be more difficult to prove. However, there is a way you may be able to get evidence.

If you are able to get an application for something else from around that time - a life policy or mortgage, perhaps which has such a cross might prove it.

I think it is worth going to FOS. The only difficulty might be if it was taken out at a time when M&S did not subscribe to the GISC code of practice, in which case FOS would not have jurisdiction.

Just got 4 refusal letters (out of 16 claims) from Barclays - they all say the same thing, that they "have been unable to locate your payment protection insurance policy...". However, I sent it to them with the claim, as requested - but luckily made a copy! I am disgusted with this slap-dash turn down. How can I contact someone higher...is there an email address?

I would go to FOS if I were you. Provide a copy of the response from Barclays as well as your original letter of complaint and the policy document.

Make four separate complaints (I know it is a pain but that way you can keep track of which is which).

Presumably you intend to accept the other 12.

  • Hi All
Am a newbie on here but wanted to know if any others have had rejection letters from Lloyds tsb and then gone on to get a payout.

My claim has just been rejected even though i sent them a copy of the agreement where they had ticked against me working under 16 hours and my job been only temporary (which was true) They had also ticked yes to boxes that said i was under 18 and would be over 70 when the loan was due to be paid off???, so very untrue.

But all of these ticks led to me not been elegible for the insurance in the first place.

    Any feedback very welcome
