  • Just a quick query to any one who has had First Plus complaints. Rang them today to check on my complaint raised at beginning of July not had any updates since the the 7th July. They are now doing callbacks - the guy who rang me back an hour later said they had sent me a demands and needs form to fill in (have not recieved it) a week ago - is this normal - on my other claim they just sent the questionaire from the FOS. They have till 25th Oct till 16 weeks are up. Just wondering what this demands and needs form is - its a settled loan from 2005 by the way? Any suggestions or anyone else had one of these forms?
  • Hi All

RBS giving me run-around so time for email to CEO
1st phone call the man told me a cheque would be sent
2nd phone call girl told my money would be paid into my old Natwest Account that I no longer have access to
3rd Phone call girl said all the monet sent to credit management team and they would send me any money owing
As the loan was cleared last Dec I feel that they should be sending me a cheque for the whole lot and wish to tell the CEO

So...being lazy as I have seen it on here but may I have the CEOs email address and also I have seen emails with the FOS condition that if there is no outstanding debt the moneys must be paid back in full. is it possible for that excerpt to also be sent to me so I can chuck that at the CEO
    Thanks
Hi just want to say RBS are definitely giving us different information,My misselling case is apparently being dealt with by their finance department and the very nice gentleman at the RBS call centre (which I think we are dealing with) told me RBS do not send any refunds out to CMC but direct to the customer and that my case should be settled by them by the 21st October which is the eight week deadline (But I am not holding my breath) - since my case has been with them since September 2010 and upheld in my favour by the FOS I really do feel we should be treated with more respect in that we are being given some correct information - good luck with receiving your refund I have given up looking for the postman - any information I have had regarding my ppi has been from Cappo and friends to which I am truly grateful that we have someone working on our behalf - we owe them alot for their time and expertise

this is what the bank should have gone over with you in the first place to make sure that the ppi was right for your needs the fsa guidance on it is

FSA review of good and bad practice
Our most recent review into PPI sales, published in September 2007, showed improvements in some areas, but also that many small firms were still failing to treat their customers fairly when selling PPI.
    Poor practice we found included:
Not explaining the PPI product clearly, including significant exclusions and limitations of the policy.
Failing to ensure the customer was eligible to claim against the product.
In advised sales, not finding out whether the PPI policy was suitable for the customer.
In advised sales, poorly put together statements of demands and needs that did not explain the firm's recommendation or tailor the information to the individual customer.
Inadequate systems and controls in place around the sales process. These could result in sales staff not following the firm's own processes, and ultimately for inappropriate sales practices.
Action we have taken on PPI
We announced in September 2007 that we would seek to impose larger fines where appropriate to provide greater deterrence for poor sales practices in the retail market generally and the PPI market in particular.

Wonder if one of you fabulous "calculations" people could help me?

I need someone to help me work out roughly what I should be owed as a figure has came off my loan balance so presume a letter will be on its way.

However my situation is a bit complicated so if anyone is willing, could you kindly PM me when you are free and I will explain and send you figures etc.

    Thank you so much x
Yoo hoo :D the amount off the balance is possibly the total ppi,is the figure the same as the ppi?.

In 2002 we took out a mortgage with HSBC, during our meeting we were told we would have to take out mortgage protection plan with critical illness, and separate PPI (joint mortgage), as well as buildings and contents insurance with the bank - he specifically said this was a term of the mortgage. The buildings and contents we only had for a year as we renewed elsewhere. But had the other 3 policies well into 2007 probably totalling about 11k in all.
Despite this HSBC have said we don't have a claim is it worth going to the Ombudsman -this has taken them 5 months to come back with a no! Had we not been told this there is no way I would have taken out these policies with the bank I would have shopped around.
Hi there, you would get more help with this if you post here

There are people on there who are more knowledgable with mortgage ppi.

    Hi,

Can anyone help me, once you have received a final response letter ie rejection letter, if you then send the company further complaints not in original letter of complaint, do they have to investigate or does the complaint stay closed?
I have been looking on the FSA handbook, but can't make head nor tail of it!!

    Thanks
When they have given you a final response, you have to go to FOS.
With the details you have ;)

    Hi,
I would like to clear up some small points in what I wrote on 3 October.
Egg had already paid the full amount of my PPI in 2 parts £ 2,020.01 in 2009 and £ 2,281.97 in July 2011.
Prior to this, Egg SOLD my loan balance to a debt collection company ILLEGALLY in July 2010 with a balance of £ 10,620.03.

Which is £ 8,901 loan with £ 3797.97 PPI MINUS £ 181.68 taken from £ 752.98 worth of payments and £ 2,281.97 from the PPI PLUS £ 384.72 accrued interest.
Since July 2011, Egg have left the £ 2,020.01 and the £ 384.72 on my loan of £ 8,901 which I say is FRAUD because the FULL amount of PPI had ALREADY been paid off.
See what I am saying, the ACTUAL BALANCE of my loan with Egg is £ 8,215.31 but Egg say it is £ 10,620.03 at this present moment as this was the amount SOLD to a debt collection company.
I am now confused. The FOS have CLOSED my complaint with Egg even though they have had it since November 2009 and the NEXT STAGE would be the COURTS.
Also, Egg have not sent me an ANNUAL STATEMENT since APRIL 2010 which my last one due in APRIL 2011 and under the Consumer Credit Act 1974, Egg have committed an offence and denied any wrongdoing.
and Under the CCA of 2006, I am NOT LIABLE to pay them anything during the period of NON COMPLIANCE which means they owe me money I think.
How can I get this money without going to the courts and without the help of the FOS ?
Egg have refused to respond to any of my communications whatsoever regarding any matter regarding my loan with them.

    Any Ideas ?
    Nickybutch
Evening, when EGG paid you the 2 amounts of ppi back, did you get this to you?.
If we take one issue at atime,we will be better placed to help you.

    Hi Cappo

thanks for that - not sure what they expect me to fill in it as it was about 5 years ago - dont even remember my major outgoings like my mortgage amounts never mind anything else- oh well - will see what it says - the guy who rang me back didnt seem to know what was going on with the account at all - so wouldnt be surprised if i dont even get the form.

Seems strange that my other ppi claim with FP got redressed without doing one of those forms?
