PPI Reclaiming Discussion part 4

    So I sent the request as above, but they replied stating without the account reference they couldn't do anything.

    Luckily I still have bank statements since 2004, so after some rummaging I found one with my DD payment to ALPF (Allience & Leicester) with a reference number.

    Photocopied and sent this information to them, thinking all would be well, then they have replied saying they can't find any record of it.

    So I have proof and a reference that I was paying off a loan to an A&L subsidiary in 2006, but Santander (now owners of A&L) can't find any record of it.

    Is this a breach of DPA laws?

    How can I get this sorted without a copy of the credit agreement?

    Help! :(

    my letter too was dated 27th aug and no not received mine yet

    I've been having this with LTSB luckily i did get some account numbers on the 2 credit cards i had with them and 1 loan they've said that i did'nt have ppi on, ha whats the chance of having a 7k loan and the bank saying don't worry about having ppi, lloyds tsb nah, but yes rodd i'd say it is a breach of the dpa i'd contact the ico and fill in there online complaint form sometimes these banks will not budge

    I had a loan with ALPF (Alliance and Leicester Personal Finance) which started in 1992 and finished in 1996 and got my complaint to Santander upheld last year. I only had my account number so they must hold onto account information somewhere for a long time. I was mis-sold because I was in HM Forces at time so PPI was useless to me.

  • This may be a stupid question, so I apologise in advance!

    I have seen numerous posts in the forum stating that single, upfront PPI premiums can be seen as reason enough to show a miss-sale, but I have not seen an explanation as to why (although I have not read every post, I'll admit). Would someone be able to clarify the rationale please?

    I'm sorry if this is a numpty-like query.

    HI KG and welcome to the forums, it's because it is seen as being a second loan on top of your original loan, plus the interest is charged on the 2nd loan(PPI) for the duration of the main loan, so say you borrow £10k over 15 years, plus £4k for the ppi, you are paying interst on your £14k for the duration, BUT, the ppi only covers you for the first five years.

    Thank you for that Smitchy - that helps enormously - and makes me feel a little more confident about my complaint :)

    But just to understand more fully, if I change your example slightly, what is the result? If the loan duration was 5 years and the PPI cover was still for 5 five years, then the fact that it is a single premium, in that scenario, would not be a miss-sell? Is that right?

    Sorry for being a nuisance - early morning rugby does not make for a fully functioning brain with me!
