A I stated Cappo this was all arranged with Albion over the phone!! They (Albion) have admitted to us after playing back the taped telephone conversations, that we paid the settlement figure quoted to us at the time and any mistake that may have been made by themselves will be written off. Unfortunately nothing in writing though, but we have names and details and this will have to be fought to the end. We certainly would not have paid an amount over and above our arrears if it was not the final settlement figure.

it's very strange that they did'nt send you anything through the post, never mind contact albion and ask them for a transcript of the phone call they will have to give you this, although there may be a fee involved a lot depends on what was said over the phone, but ppi being entirely seperate from the loan, a standalone addition as it were should not affect this anyway, i would as you say strongly challenge this and consider contacting the fsa and the ministry of justice re the somewhat strange way albion do business.

Hi little bit of advice wanted - I've been looking at the info about reclaiming ppi but there is so much info on here to read through. I just wondered if someone could tell me whether I would be wasting my time but I had a car loan with Barclays in the early to mid 90's and a mortgage with Abbey National - I'm pretty sure I would have had PPI as I was quite young at the time. I have no paperwork going back to these. Sorry if this seems a daft thing to ask!!! I'm sure I have read somewhere about anything over 6 years probably will be unsuccessful. thanks for any help.

HI tcem, no it's not a waste of time it's just another one of the unending excuses the lenders will use to get out of paying you anything .ask the bank for the relevant information you might hit paydirt and they might give you the info over the phone other than that you could cca them and this would cost you £1.00 with a 12-14 day wait but if your accounts are closed the lenders will probably not comply, sar them as a last resort link below.

  • Hi everyone,

Just wondered if anyone has had any luck with Halifax, how long did it take you to receive your letter detailing their calculations and then payment after sending back your acceptance form?

    Thanks :)
  • Hi,
I am at the end of a PPI claim against Blackhorse. PPI that was mis-sold to me was £4035.23. Because we had a successful claim of £6774.72 when my partner was off sick due to Achilles tendon rupture (and then re-rupture) they stated in my redress that I was sonly due £475 which included 8% interest and stress compensation, however, when I got my redress through it had stated as follows-
    Full Amount due £4035.23
    Less £ 6774.72 (successful claim)
Less £879.23 (arrears from part one of loan)
    = £0.00
    Plus 8% interest £ 375.09
    Plus stress compensation £100.00
    Total redress £475.09

I called them to ask about this arrears as far I was concerned the arrears that were on the account was due to the PPI taking 2 months to kick in, and then we used 2 reduced payments when my partner went back to work (he had to do months lying time), which I had already agreed to change my agreement to adding this on to the end of my loan. And I had asked them not to pay anything to arrears and he confirmed that this £879.23 was the monies that was due to what I have described above that they had to pay that as they were now chasing it, I told him that was nonsense, they were not chasing it and that I spoke to someone in their department every month to pay my loan and never once has this been raised to my attention. He said that there was nothing he could do about the £879.23 as they had already issued a cheque for £475.09 which was bog standard amount I was due, but on the bright side that I was not to worry about any arrears on my account anymore because it was now on a “level playing ground” his exact words and that now my credit file would not show any arrears !

So today I got a call from customer services from Blackhorse saying that my account was now in arrears, I was like Eh ?? and she went yes £475.09, I went no its not, I had spoken to someone last week and they said all the arrears were covered with PPI claim and the £475.09 was bog standard what I was due (minus the arrears they had already taken into account) she looked through my account and confirmed what I had been told and said she cant understand why the refund cheque I got through has came off my account and now knocked me into arrears. I spent an hour on the phone and she can not get the man I was dealing with last week (holiday apparently) and she has confirmed that she has went through my notes and she cant see why this has happened, no-one in the PPI department can explain it and she has to wait until tomorrow until she can speak to the man I was dealing with in complaints.

This has been a week and half long fight with Blackhorse as they told me on 9th when I had called to ask re arrears noted on the PPI redress that my account was now clear and closed, for me to get a letter on the following Tuesday that my new monthly payments minus PPI was £199, when I called them to ask why I had it that I had been told account was closed, I was then told oh no that has been a mistake and the PPI refund had been paid back in to my account made it a – balance but now it was sitting at £1439.89, to then get a letter in on the Wednesday to say that my account was sitting at £3456 arrears and needed paid IMMEDIATELY, I called them back for them to tell me that this was ANOTHER error and I was to rip the letter up and that it was all to do with PPI claim again, and they would cancel my payment plan and I needed to call collections and set up a new direct debit at my leisure as long as it was before 2nd October (when next payment due) ! To then be told the Thursday that my account was all up to date and showing no arrears and that my outstanding balance was defiantly £1439.89 and asked my permission to close the complaint I had been pursuing re being told originally that my account was closed. Then I called today to make new arrangements for next payment to be told today that my account was sitting at £475.09 arrears, which have been worked out as the PPI cheque refund ! I asked whether I was to return the cheque and she said no, that’s what you are due, I don’t know why its came off your account ?? I am completely lost ??

I feel sick to my stomach as no one can tell me anything at Blackhorse, I am getting a different story/amount owed every phone call I get. Anytime I have asked them to read through notes on the account it always misses out the bit I am complaining about that I was told, plus the phone call recordings always seem to be missing mine ! Apparently they don’t record EVERY phone call !!

Has anyone else had a redress/PPI claim that has worked out worse off for them in the outcome ??

Hi all, I am after a bit of advice where to do next.
I have been knocked back by the MBNA for a claim on my credit card ppi.
They have sent back a copy of my application form showing where I have ticked for ppi, but the tick goes in the opposite direction to all the other tick boxes i would have ticked but the tick is the same direction to the sales reps where they have filled other areas of the form. I cannot remember (got card in 2003) but I can only assume they ticked the ppi box when I filled in the form. Also they have stated that I have not adequatly proved that I could pay the payments if I was ill or whatever. I think the tick bit this is a bit of a thin excuse and am not sure what to do next, not sure FOS would do anything based on the tick issue.
    Thanks for any help.

So sorry to hear about all the problems with this one, hopefully someone will be along to deal with this for you, in my opinion though an email to the CEO of Blackhorse, not sure if this Mr Osario or not but hopefully someone can help there.

I would contact them giving a full run down of everything you have said here and ask them to investigate fully, as you don't know if you're due the £475 or what is happening to your account, you are so confused by all of this and it needs top be clarified, just goes to show you that one hand doesn't know what the other is doing with the banks, no wonder they and the country are in such a bl**dy mess.:D
Thanks to all the competition posters.
