  • hey guys....update....update...:p:p

    After contacting CB last week after they requested i speak with them & them telling me that they uphold 1 of my loans (I had 3, they were all rolling/refinance) i emailed the CEO & PPI mamanger to explain that under FSA guidance, banks should consider all loans blah,blah,blah..;) anyway, emailed the PPI manager back tonight to ask if they had chance to read my email amd clarify if they would look at my other loans or i would need to SAR them (which i already have...wasting no time :p) and i have just got this response....
    ."We are in receipt of the further email sent and a further review has been completed we will be in touch with you in due course to confirm our position".......:eek: (dances) what do you all think??
    Do you think they will look at my other loans or give me the brush off? :):)xx

    If you still have some of the paperwork, we'd need a breakdown of the figures to be able to have an idea of what you could be due back but for starters, you should be due back all the ppi payments you have made, you might find that from your monthly payment of around £220, £180 might be for the loan and it's interest and £40 for the ppi and it's interest, therefore you'd be due back say £40 x 44months(whatever you paid for), plus you'd be due 8% simple interest on each of those £40 from when you paid them. Also when your first loan was refinanced you would probably have received a ppi rebate, but the rest of it would probably have been carried forward on to loan 2, so you'd be due to get that back too, as if that hadn't been there you wouldn't have needed to borrow as much in loan 2.

    Hello

    Just received information back from Santander for an old loan taken back in 2001. Sent a SAR letter and received full information that I am finding really difficult to understand.

    On the very full sheets of data received it says Mthly insprem: 0.00 which I would assume no insurance was included. But then further down it states Int On Cap: 115.92DR followed by Int On Ins: 8.60 DR, which seems to indicate insurance??

    Can someone give me some advice please.

    They have not made things clear as such, as if they are trying to disguise the insurance as such, yet it does state some details of the insurance, I thought DR meant Overdrawn but could be mistaken in this instance.

    What I would do is contact them on the phone, give them the details of the account number and ask then bluntly of is this is insurance as you are having this checked out. (so that they don't try getting out of it, if you know what I mean).;)

    Or continue to give it a shot on the reclaiming, by completing the reclaim questionnaire on step 3 below, and send, remember to keep a copy, good luck.

    Hi there


    This is so common unfortunately with dealers dissolving etc, but do contact the FOS who may advise in this case to go the underwriter direction, and as the dealer are no more, the lender on request should send you a copy of the insurance policy details, the underwriter/insurer details will be enclosed.

    Do call the FOS though first and take it from there.

    OOH, I am hoping this means good news, and quite right too to tell them that the FSA expects them to look back into other accounts, am keeping everything crossed for you, if they do fail and reject on the other ones, then tell them you will be contacting the FSA.

    I will :o - oh i am excited.....i know the other loans go back to 1998 & they say they can only pay out on the last loan i took due to it being in 2004 but surely they can look at all of them & not just the 1 ;)
    I have sent a SAR regardless as they say they simply just havent got the paperwork going back then..but i have told them that every single loan (3) was taken out in exactly the same place, same circs, so if they have upheld 1, the rest should be the same.....here's hoping :A:A

  • Did post a more detailed account of all this but its disappeard into cyberspace, so here is the shortened version.

    As we were in arrears our account had been passed onto the Albion (the debt collection arm of the Halifax). In May 2011 after receiving the settlement figure from them we paid off this loan. So we were completely astonished to receive a statement from Halifax (not the Albion) in August 2011 showing there was still a balance owing on our loan. We contacted the Albion who checked out the details and listened to the taped telephone conversations and it showed that we did in fact pay off the settlement figure that was quoted to us and they said that as a consequence (even though a mistake may have been made on their part) any amounts due would be written off. Imagine our shock this morning on receiving a settlement letter from Halifax stating that as there were payments still owing on our loan we would have to agree to sign a new loan agreement (minus any ppi) before we could get any ppi that is due to us refunded. Now to me this does not sound right............ A NEW LOAN AGREEMENT??? What do the experts think about this? I am begging for some advise pleae!!!
