Hi smitchy and wilf i was in the same position as both of you i had 47k worth of unsecured debt and i will say wilf it's too easy to do, i am not particularly good with money but to this day i don't quite know how i got there, the problem being you take out a credit card then pay it off with a loan and so it begins all over again when you remax out the credit card, i went onto a dmp and found that easier than going bankrupt which i could'nt do at the time, luckily for me i had critical illness insurance which when i had my stroke paid everything off thankfully, the easiest best way round it, is always talk to your creditors and you will find that most of them will cut you a deal, good luck and if you want to talk wilf just pm me, good luck:)
Thanks cappo, good to hear other similar stories too and it's always best to know you're not in this alone, hence why we're all here to help others now, it would be easy once we get our payout not to come back on here, but I don't think I could do that, everyone at home and work are fed up listening to me:D ahh who cares!:rotfl::rotfl:
Thanks to all the competition posters.

eirelav, didn't you fill in the fos questionnaire when doing the initial complaint of mis-sale, although with Barclaycard I think this is normal. Others may have personal experience.:D

Thats a bit naff steve....why do they do this? Is it just to buy themselves more time?xx

I think so sunny, you know what the banks are like it's a constant battle with them isn't it, but at least we on here know what we can do about it. haven' got a lot planned for the weekend so far we'll have to wait and see, we're all keeping everything crossed for you. let us know on monday whether you have an uphold, it sounds as if you will have and we'll give you the victory parade and a spinning martin lewis lol.

    Happy Friday everyone, whoop whoop.

Had good news today from Barclaycard (well I am hoping it's good news!) following my email to them on Tues, had a call this afternoon telling me that after 13 weeks they have been unable to locate my details so fax them all the statements I had, which I duly did. Now here is the problem I have a selection of statements from 1995 - 2001 with varying amounts of PPI on them ranging from £6.18 - £25.90 per month, the first one I have is April 1995 and the last one I have os MAy 2001. some are missing, I know I was paying ppi until around 2003. He said the directors office will look at it on Monday, and it wll then be passed to work out an estimate.
Does this mean it is upheld? Can the director decide not to uphold it? My statements show a total paid of £700, with the missing months not including 2002 and 2003 ppayments I work out I roughly paid £985, but if you add 2002 and 2003 i would of paid prob in the region of £1400 prob more.
Has anyone had a similar experience and if so did they offer you on the upside or downside of your estimates.
Anyone any idea of roughly what I should be accepting (providing of course it is upheld, but he def gave me the impression it would be, just scared to count chickens and all that!)
Sorry to bombard you with so many quesions especially on a Friday night.

Well done to all this weeks winners.
Hi lynk, I think the FSA guidance is to use an average amount based on the card history, but no doubt they'll have the info just not wanting to share it with you.
The thing with the CC is that they take the first ppi charge from the first time it was added to your card balance, refund it to the account along with any associated interest they charged on it, if this takes you into credit then they should pay the 8% simple interest on that, but this has to be repeated for each months ppi charge made to your card.:D
Thanks to all the competition posters.

hi amersall sent a letter about being misold my ppi on my credit card with barclaycard was wondering why u have to fill n the questionare thanks

Hi, there all using this now as the standard between the banks, the idea is if the complaint is rejected (lets hope not) then the form can be sent straight to the fos, make sure you keep copies and send by recorded delivery.

HI there - I also sent my acceptance letter by recorded delivery last saturday (3 sept) and still hasnt been delivered. contacted post office. very unhelpful. they said it could take until 22 sept. am afraid I lost my temper and put the phone down (foolish I know). Anyway fortunately i had taken a copy of my acceptance letter and have now faxed it to Halifax with another covering letter explaining why. dont know if they will accept a fax but I always live in hope.

    C.x

Don't see why not, banks fax info between themselves all the time, you should be alright, quick thinking taking a copy, well done.

All the banks and credit cards agreed a questionnaire with FOS which basically has most of the questions for info relating to your mis-sale, and if the bank/lender rejects your complaint of mis-sale you just have to print off another copy of your questionnaire along with your final decision and send it to the FOS, save's having to do it again and it keeps the information the same also. I think also once FOS receives a complaint they ask for a copy from the bank also just to ensure it's the same details, then they can look at both sides of the story to make their decision, although not sure if this is what they do, just my take on it.
Hope this helps, by the way don't worry too much about the definitions of the way you say, it doesn't have to be full of terminology, but if you made points about your mis-sale in the letter use the same points on your form, and if there is any supporting documentation which will help you send COPIES with your form too.
Thanks to all the competition posters.
