    It's not that you were naive, I think almost everyone is on here as they didn't read the full paperwork in one way or another and if they did went on the words of sales people when saying you need to take the insurance to get the loan, even though the paperwork says the insurance is optional.

    I know they are entitled to phone your work to check with the details you gave them are correct, not sure about checking when you're coming back to work falls under that category, I would also be thinking about a data protection complaint to your employer, but thats one for an expert, are you in the union at work, if so speak to your rep about it, or even phone your HR dept.

    As for phoning i'd be more inclined to put it in writing especially quoting FSA handbook sections relevant, as on the phone they might get you tongue tied or put words in your mouth etc, but of course you could be smarter than them and me in that format of communicating!:D

    I agree with you, i'm going to write to them with PPI complaint again. Phoned them today and got a breakdown of the figures they sent us and left it like that.
    Have found more info, they sent us courier guide sheet
    and it states
    ....7 check the compulsary signature box...
    8 Please ensure that if customer has taken insurance (as indicated in n.o.11 (this has a big tick)that they sign and date the insurance part
    9 ONLY when you are satisfied that the documents have satisfactorily been signed, hand the customer envelope number 2
    What would have happened if we had refused to sign the document? They really are a bunch of cowboys

    Hi Guys,

    quick recap ...

    I have a First Plus loan which incorporated a previous First Plus loan - I wrote to them last Thursday requesting repayment of the PPI paid on both loans and restructuring of the current loan to run as if PPI hadn't been included ..

    I recieved my first response from First Plus this morning and would like some advice, the letter in it's entirety is as follows:

    "Dear Mr ***,

    I am sorry you have had to contact us regarding the sale of your payment protection insurance policy. Thank you for taking the time and trouble to do so.

    However, I note from the account that the loan was brokered by 21st Direct Limited. As such we are unable to investigate the sale of the insurance policy. As 21st Direct Limited have ceased trading you may find it useful to contact the Financial Services Compensation Scheme (FSCS), 7th Floor, Loyds Chambers, 1 Portsoken Street, London, E1 8BN.

    Please find enclosed a copy of the 21st Direct Limited application form originally completed by you for your records, if you require any information on how your claim will be handled please contact FSCS.

    Yours sincerely etc."

    Included is a photocopy of the paperwork we completed at the time of the original loan - £7500 with Single Cover PPI ticked !

    This letter appears to be about the first, now consolidated, loan only.


    What do I do now ?
    Hi there, what year was the 2nd loan? and how far have you got with FOS?.

    we all know he made silly mistakes but peer pressure essentially led him to be in the mess he was in then, along with being thrown loans etc left right and centre head out of the sand now but doesnt want to suddenly create whereby debts rear heads and hound him, although he does want to make headway into clearing them, essetially i dont want him to be scared off and bury head in sand again but take a realistic approach and work on reducing them
    main question being

    can he claim back the ppi even tho he has defaulted on the loan bigstyle

    what would anyone suggest as the best way to deal with this

    First of all,when he left football,why didnt he claim on the ppi?,as he was in effect unemployed.
    If he was given the loan and his contract was only temporary,then this is a reason for mis sell.

    If any/all apply to him,then put a claim in.
    You will also find the FOS letter to fill in on the links i gave.


    All you need are the account numbers,the credit card number is what you need for a cc.
    Send the FOS letter to the banks recorded delivery and give them 14 days to respond.
    Most banks do complaints over the phone,so may be worth ringing first.
    If he wins,the whole redress will come off the loan/cc but that is a good thing then he will be nearer to clearing his debts.

    Makes it look as if it's a compulsory insurance for it doesn't it, although, if you decided not to take the insurance at that time there would've been a need to re-do paperwork.

    I'm assuming envelope no.2 was the cheque for the money?

    You'll get there in the end i'm sure.

    he basically had got an apartment with his massive earnings and ran up debts there and was effectively hidding from them, by the time he opened up about everything we are in the present

    he didint know what ppi was or what he had signed up and he didint know that he could claim he just assumed it was part of the loan iyswim

    I think they are allowed up to 8 weeks for calculations and payment to be awarded.

    He's not alone, I done this too with one of my loans, he should be able to claim back the ppi as one of the others said in an earlier posting. Anything awarded to him will probably be taken off his arrears, but the total of his amount owing should drop a bit as well.

    Is he managing to get his debts sorted out now, or is he still kind of burying it. The people at the CCCS are brilliant at helping out. Even having a look at the other boards, Debt Free Wannabee etc could be helpful, there are loads of folks on there that know ALOT. He should be very thankful to have you around to help kick start this, I didn't have anyone but have came out the other side alright after eventually seeing the light.:A Just awaiting 5 loan ppi's with RBS and one CC with BoS, had two loan ppi's with Clydesdale Bank refunded last week, and a fair sized CC paid off in full with it,:D
