Hi all, I received my cheque payment from lloyds today, But i was shocked when i opened the letter, Previously i was told i would receive a payment of £431.03, but my cheque was for £40.11, This amount is the interest only, So do they send the interest out seperate from the main payment? any help would be appreciated.0

I contacted Barclay Card and asked for a copy of my credit agreement and enclosed a £1 chq. They responded:
"As no sum is, or will or may become payable under your credit agreement, Section 78(3)(a) of the Act provides that we are not obliged to provide you with the documents and information you seek. "
I called Barclay card to find out what this meant and no one there would help me and said thats all they could do.
What do i do next? I dont under stand the letter and not sure what to reply.
I contained the chq and the account number from this credit card account that closed in 2007. They should still hold all my information, but whenever i call them, they claim they cannot find me on their system.

Do not worry about the credit agreement, just make a reclaim, you don't need the agreement to make a reclaim, as long as you think you were sold and mis sold PPI.
If the account is settled/paid off they are trying to say they are not obliged to keep copies of these, but just continue with a reclaim, they will still hold the main of the data going back to at least the last 6 years so they can still investigate.
They MUST though oblige to a Subject Access Request (SAR), this is an optional request and they have 40 calendar days to comply and send all they hold on the account going back the last 6 years, some will hold data going back prior to that.
However, with this request, you enclose the one off payment of £10 cheque or postal order.

But remember a SAR is optional and may be useful if you have no details whatsoever to help towards your case.
To make a reclaim, you just complete the reclaim questionnaire as on step 3 below, send to the ones responsible, head office or complaints, keep a copy for yourself.
They usual is 8 weeks for them to give a decision, but currently the FSA have given the main of the banks 12 weeks.

I would contact Lloyds to find out what is going on, just in case they made a mistake.
Is the account still an open active account? and is it a credit card?
I think if this is the case they may have awarded the refund towards the card and sent you the interest by cheque separately then, if again this is the case and they did not actually state they were doing this, do let them know you want this refund directly to you because you have already been deprived of your own money.

I have contacted them, But they just said they will email the finance team and they should reply by next thursday....and the account is closed and it was for a loan which is also closed, I am hoping that they have just sent the interest in a seperate cheque for what ever reason0 -

They defo seemed to have made an error then, and should therefore also send you the full refund, they must pay you what they said they were going to pay you, because its no use them forwarding the amount to a closed account no longer used.
I would personally contact them again before next Thurs just to make sure they are dealing with it. They will have to refund you. x;)The one and only "Dizzy Di"0 -

Just spoke to someone else, And they told me that an error has been made, And to call back next week to see when the remainder will be sent out to me, Unfortunatly i have a feeling that this will involve another 7 week wait :mad:0 -
