  • I contacted Barclay Card and asked for a copy of my credit agreement and enclosed a £1 chq. They responded:
    "As no sum is, or will or may become payable under your credit agreement, Section 78(3)(a) of the Act provides that we are not obliged to provide you with the documents and information you seek. "
    I called Barclay card to find out what this meant and no one there would help me and said thats all they could do.
    What do i do next? I dont under stand the letter and not sure what to reply.
    I contained the chq and the account number from this credit card account that closed in 2007. They should still hold all my information, but whenever i call them, they claim they cannot find me on their system.

    Advice please......

    Firstly may I apologise or having to email you, I appreciate you are a very busy man but unfortunatley I feel I have no alternative.
    I first contacted your company back in January (then outline your comments and timescale as on your post above).

    finish it along the lines of,

    As I'm sure you understand that as a long time, loyal customer I feel very let down and am hoping that perhaps you can help me. I am reluctant to take this complaint to the FOS but if I don't recieve a reply within 14 days I will have no alternative but to do so.

    Thanks LynK, i emailed ceo at 6pm last night and got a personal reply at 10.40pm saying no need to apologies and gave me the name of the person who he would allocate to look at my complaint, so it does work:j

    Hi tori, if you've had no joy with barclays you could sar them they would have to provide this under the data protection act 1998 if the account is closed they are unfortunately within there rights to refuse to do what you ask but they can't refuse a sar link below with info
