    hiya all!

    i have just got my SAR back from cap one, i dont really understand it i will be honest!

    it consists of some screen dump printouts from their systems, and then a printout of all transactions on my account from start to finish, they did include a term/abbreviation sheet also..... what do i do know?? its seems like gobbledegook!!

    Hi Jonathan and welcome.;)

    Yes both PPP and PPI are of the same meaning.

    If you feel you have a case then I would go for trying to reclaiming on it, make sure though there is a cover in place such as a stand alone cheaper option if this is still ongoing.......in case of the unfortunately happens.

    There is some useful PPI info and template reclaim letters you can use, if any of the reasons apply to you add them in the letter as well as the reasons you have given in your above post.

    They have 8 weeks to respond in full, write back to them again if they send you a fob off first response, keep on at them until you receive the final response, if not still satisifed you should be given information about the Financial ombudsman service (FOS) to take this further for investigation - again a free service, and post all letters by recorded delivery.;)

    I take it you still have the agreements for these?

    If not write to their data dept, and request for copies of the agreement, enclose a £1 postal order or cheque payment to cover this, they should supply to you by 12 days of request.

    Crikey these SAR's I know what you mean.....:rolleyes: .

    Have you the agreement for this?
    Did they post that amongst the SAR or did you request for that separately?

    Is there any information at all of the PPI?

    I am not all that up on the SAR's myself but I know some bits of it may be useful to use if required for your case.

    Did they send you any telephone recordings, if any were made over the last recent year?
    Or telephone transcripts of dates, times and what the conversation was about?

    Anything PPI related should be handy and phone calls etc, dig them out, hope its all there, if for some reason you feel something is missing and know it should be there, contact them ASAP and request for the missing info.;)

    I have just looked at the letter i sent them, this is what i put:

    I am writing to request a fully comprehensive list of all the insurance charges added to my account with Capital One Bank (Europe) PLC. If you are unable to provide this data, I will accept copies of my statements. I understand that statements on their own are not covered by the Data Protection Act, yet I’m not requesting the statements per se, but the charges, which I’m entitled to. I enclose the £10 fee for this.


    SO i think i have messed up a bit!! god im angry with myself :mad:
    there is nothing that mentions PPI specifically, just one entry on the system where it was cancelled, but that was from when i closed the account anyway, so of course it would be cancelled then... there are also entries on from when i wrote to complain that i was still receiving letters and cheques 4 months after i had closed it.. and when i wrote in to change my surname was i got married. but no opening details, ie, application form (think i did it online though) or telephone calls...

    do you think its worth me just adding up all my insurance charges and then sending them the letter asking for it to be refunded?? I know they have been fined for mis-selling PPI, and i am 95% sure i wont have ticked a box when applying... having said that it was a long time ago... and at present i stuggle to remember what i did last week never mind 4 years ago! :rotfl:

    Don't be angry with yourself, your doing fine.;)

    These companies never make it easy do they?

    Hun you do not have to put any amounts in if you don't want to, because to resolve this they would have to refund you all amounts and interest as if then at the time you did not take out this cover.;)

    Go for it, and go back to check this link for more info as well to help your case and letter:

    think i will just post the letter today, just worked out that ppi paid = £149.29 so i will chance it. fingers crossed I get it as then thats 149.29 to throw at another debt :o thanks again.

    Need to know how to go back to them as I had drafted a letter:

    Thank you for your letter dated February 2009.
    In the letter you have offered a 'full refund of Insurance policy plus interest charged', may point your attention to your reference regarding my early settlement. In this paragraph you state that an early settlement figure was calculated which included rebates of insurance premiums. Please send me all correspondence and documents relating to my acceptance of the cash rebates detailed on your letter as I have never received any cash rebates, so these too are owed.
    To my calculations, the sum offered is considerably lower to what was actually charged to me when I initially took out the policy. Life & ASU detailed in your letter are incorrect against the information sent to me by HFC previously. It is based on the information provided to me by your company regarding my loan I have calculated that HFC bank owe me the sum of £2,500(PPI ) +£5,000 (interest applied with loan) + 8% statutory interest that a court would award.
    The total I therefore require to be paid to resolve this issue is £7500.
    I am prepared to accept the amount offered as part settlement in respect to this matter.

    I hope that we can amicably come to an agreement on this matter but due to your default of the request made in respect to The Consumer Credit Act 1974, I will rigorously argue against any defense you may bring if this matter proceeds further.
    If you agree to refund the outstanding detailed herewith then I will draw this matter to a close.
    If you do not respond, or you do not respond positively, within 7 days, I shall be taking my complaint to the Financial Ombudsman.

    Please consider this a before action letter.




    Any help & Advice would be really helpful as I have to respond within 10days.

    They have not given you much time to think about this have they?

    Yet they want all the time in the world if the shoe was on the other foot.

    I would copy and post this on the ppi reclaiming discussion thread above the page, hopefully Turbo will be along to take a look at this, good luck and to my knowledge "yes" you can claim in regards of the first one, Turbo should be able to work this out for you as well, so with a bit of luck he will post in later, he generally goes onto the reclaiming thread.;)

I sent a letter to advise HFC that I would accept their offer as part settlement they have written to tell me they will no longer be responding to me as I have apparently 'exhausted the Banks internal complaints procedure'.... Couple of things I want to check, they have made me an offer which I suspect is considerably lower than they information I have in my possession. If I sign their agreement to accept this in Full & Final Settlement, will I no longer be able to claim?
    I have asked them to send me all literature concerning my account and they have never sent me anything?

    Really really need some help here, I need to know if I am being taken for a ride here..

  • Hi I'm new to the forum and currently in the process of claiming back ppi on a loan of £16600 (plus £5421.10 ppi plus premiums??)from LLoyds started 5 and half years ago. I was told at the time of taking out the loan I had to take the ppi or the loan would not be approved. I have recieved the acknowledgment letter and rang today as I am haviing trouble cancelling the ppi (Have been diverted to different departments 15 times!!) I eventually spoke to a girl who said they would be happy to rebate the remainder of my ppi (£1600) off my balance and if they agreed I was due the remainder of the ppi which I have already paid they would deduct this from my balance also (£3700).This would not reduce my monthly payments nor would I get a cheque back but it would reduce the loan term. My queries are:
    1. What is the premium for?
    2. If I cancel the PPI and accept the £1600 rebate will it scupper my chances of recleaiming the rest?
    3. No metion has been made of any interest and I have paid the extra out for the past 5 and half years so should it not come back to me for me to decide what to do with it
    Any advice would be much appreciated.

    Blimey what have they done to you ?:eek:

    You definately need some advice here from someone who knows to work around this one.

    Have you requested a Subject Access Request before from them?
    This is the one where they MUST supply all the information they have on you, although there is a charge of £10 for this by either cheque or postal order, they have 40 days to comply and the SAR letter template is on the thread.

    If you have already done that I think they should have sent you these details even now you have requested from them, it maybe also worth your while contacting the Information Commissioners Office (ICO) in regards to the documentation you have requested.
