BEV, take no notice of the "final response" rubbish, when mis-selling or fraud is taking place, until you are 100% satisfied, there is no "final"

Sounds more like frustration is setting in probably due to so many unhappy Barclays customers. When Barclays announced they would pay out regardless, they did not mention their rude staff did they.
Stick to your guns, you have the letter saying 31st August, if they don't have a copy, that is their problem

The SAR demands the info from them and maybe before that, lay down the facts to them and do not be afraid to use the word fraud, it's what these monkeys have been doing for a long time anyway.
Read through the Fraud Act 2006 below. Section 5 is a good start
Fraud by false representation
(1)A person is in breach of this section if he—
(a)dishonestly makes a false representation, and
(b)intends, by making the representation—
(i)to make a gain for himself or another, or
(ii)to cause loss to another or to expose another to a risk of loss.
(2)A representation is false if—
(a)it is untrue or misleading, and
(b)the person making it knows that it is, or might be, untrue or misleading.
(3)“Representation” means any representation as to fact or law, including a representation as to the state of mind of—
(a)the person making the representation, or
(b)any other person.
(4)A representation may be express or implied.
(5)For the purposes of this section a representation may be regarded as made if it (or anything implying it) is submitted in any form to any system or device designed to receive, convey or respond to communications (with or without human intervention).

One refinanced the other, think I only wanted an extra £1000!
I have found agreement form and here are figures
TAKEN OUT MARCH 2004 loan 1
ADVANCE - £5000
PPI - 2030
amount of credit 7030
total charge for credit 1667.10
amount payable 8697.00
APR 8.4%
This loan makes no reference to interest being added on, or is it hidden?
Taken out Dec 2004 - loan 2
loan 2 with sainsbury's
amount of credit (a) £6750
cash advance (b) £1464.60
amount of credit sainsbury's creditcare gold (c) £2741.17
interest on S SG (d) £594.23
APR 7.7%
Confused, I am - Can anyone help, I have only mentioned that I had 1 loan that was taken out in Dec 2004, with regard to complaint - loans have different agreement numbers, what do I do, if anything?

And your not stupidlol
I'm sure someone will be along soon to check the figures out for you, but normally even if you did take out another loan to pay off another you should still receive refunds of ppi plus interest from both.
Sometimes they will sort of reduce the amount of settlement from the first one of the ppi (by forms of a rebate), and you should receive the remaining minus "any rebate" given.

I am not accepting this and have written back to FLA advising so. Why is the onus now on us as customers to prove that we were mis-sold. The storecard was opened at a cashier desk within minutes, with other customers waiting to purchase their goods by my side, together with my three year old. How can they honestly say that the shop assistant went over all the terms and conditions.
I have written back to the FLA asking how can I prove I was mis-sold. The signed agreement has crosses (made by the shop assistant) where I had to sign - now a cross was by the PPI and I have signed that, but I am 100% confident that I would never have agreed to PPI if explained to me fully - why would I if I could never make a claim if I needed too.
G E Capital bank were fined for selling PPI to customers like myself by shop assistants that were really only trying to sell their 'quota' of storecards as pushed by their supervisors. Why is FLA not supporting customers like myself, they know the history, but just taking the word of Santander.
Can anyone please tell me how I can prove my honesty?? I have asked FLA the same question, otherwise it seems they just take the banks word for it again - and they get off with not refunding money that is in fact mine and not theres to have.
How did you get on with this, I'm in the same postion, just had rejection letter and trying to put a letter together to dispute what they are saying!
